On October 26, 2023, staff from the U.S. Nuclear Regulatory Commission (NRC) held a meeting with Jennifer Barnett of the Tennessee Historical Commission (THC) to discuss the results of the NRCs National Historic Preservation Act (NHPA) Section 106 consultation for the potential issuance of a construction permit (CP) to Kairos Power, LLC (Kairos). The purpose of this letter is to document the results of NRCs NHPA Section 106 consultation for the CP undertaking. The NRC is coordinating its Section 106 consultations for the CP through the National Environmental Policy Act (NEPA) process per Title 36 of the Code of Federal Regulations (CFR) § 800.8(c). The staff will also document the results of its consultations in the Record of Decision for the purposes of the administrative record.

As discussed during the October 26 meeting, the NRCs undertaking is to issue a CP which authorizes Kairos to construct a test reactor at the proposed site in Oak Ridge, Tennessee.

Kairos would need to apply for and receive an operating license to the NRC in order to operate the facility. Issuance of an operating license would be a separate NRC undertaking requiring NRC to prepare a supplemental environmental impact statement (EIS) and complete a separate NHPA Section 106 review and consultation.

By letter dated March 4, 2022 (Agencywide Documents Access and Management System ML22031A288), the NRC staff initiated NHPA Section 106 government-to-government consultation with the THC, pursuant to 10 CFR § 51.28(a), and invited you to participate in the environmental scoping process for the proposed federal action.
