Office of Nuclear Reactor Regulation Items of Interest Week Ending October 13, 2023 Idaho National Laboratory Published INL/RPT-23-74681, Assessing the Impact of the Inflation Reduction Act on Nuclear Power Update and Hydrogen Cogeneration On October 4, 2023, Idaho National Laboratory (INL), in coordination with MPR Associates and the Nuclear Energy Institute published INL/RPT-23-74681, Assessing the Impact of the Inflation Reduction Act on Nuclear Power Update and Hydrogen Cogeneration (Agencywide Documents Access and Management System (ADAMS) Accession No. ML23276B406). The report provides a financial assessment and modeling tool for decisions regarding the timing and types of power uprate, given the tax credits in the Inflation Reduction Act. Modeling tools incorporate profit margins associated with hydrogen cogeneration, a relatively new concept, with initial pilots underway. The report was shared through the U.S. Nuclear Regulatory Commission (NRC)/Department of Energy (DOE) Memorandum of Understanding to share research related to Light Water Reactor Sustainability. The NRC staff are reviewing and evaluating the conclusions of the report.

Department of Energy Laboratories by Licensees, Applicants, and Suppliers to Verify the Effective Implementation of Their Quality Assurance Programs (ML22080A051), was published in the Federal Register (88 FR 69555) for a 60-day public comment period. The purpose is to clarify the agencys regulatory position regarding the required assessment of DOE national laboratories by licensees, applicants, and vendors to verify the effective implementation of the laboratories quality assurance programs.

NRC Suspended Review of Nuclear Developments Application to Transfer Construction Permits for Bellefonte Nuclear Plant On October 10, 2023, the NRC staff informed Nuclear Development, LLC (ND) that, per NDs request to withdraw their request (ML23263A100), the NRC staff had suspended its review of NDs November 2018 application (ML18318A428) to transfer construction permits for Bellefonte Nuclear Plant, Units 1 and 2, from Tennessee Valley Authority to ND (ML23261C415).

NRC Staff Issued Kairos Hermes 2 Construction Permit Application Scheduling and Resource Letter On October 11, 2023, the NRC staff issued a letter to Kairos Power LLC (Kairos) outlining the proposed schedule and estimated resources for the review of the Kairos Hermes 2 construction permit application (CPA) (ML23269A176). The NRC staff expects to complete its review of the Hermes 2 CPA by November 2024 and estimates that approximately 10,000 hours0 days <br />0 hours <br />0 weeks <br />0 months <br /> of staff review time will be required for the safety and environmental portions of the review.

NRC Staff Issued Virgil C. Summer Nuclear Station, Unit No. 1 Subsequent License Renewal Application Determination of Acceptability and Sufficiency for Docketing On October 11, 2023, the NRC staff accepted a subsequent license renewal application (SLRA) from Dominion Energy South Carolina, requesting an additional 20 years for the already-renewed operating license of Virgil C. Summer Nuclear Station, Unit 1 (V.C. Summer)

(ML23275A014). If approved for subsequent license renewal, V.C. Summer will extend its license to August 6, 2062. The review schedule is 22 months with an estimated total of 20,000 hours0 days <br />0 hours <br />0 weeks <br />0 months <br /> of staff review time. V.C. Summer is the 9th SLRA accepted for review.

Office of Nuclear Material Safety and Safeguards Items of Interest Week Ending October 13, 2023 List of Approved Spent Fuel Storage Casks: Holtec International HI-STORM 100 Cask System, Certificate of Compliance No. 1014, Renewed Amendment No. 17 On October 11, 2023, the acting Executive Director for Operations signed a direct final rule (Agencywide Documents Access and Management System (ADAMS) Accession No. ML23082A346) and a companion proposed rule (ML23082A345) to amend the U.S. Nuclear Regulatory Commissions (NRC) spent fuel storage regulations at 10 CFR 72.214 by revising the Holtec International HI-STORM 100 Cask System listing within the List of approved spent fuel storage casks to include Renewed Amendment No. 17 to Certificate of Compliance No.

1014. Renewed Amendment No. 17 updates the HI-STORM 100 Cask System description in the certificate of compliance to indicate that only the portions of the components that contact the pool water need to be made of stainless steel or aluminum. The direct final rule and companion proposed rule will be forwarded to the Office of the Federal Register on October 19, 2023, for publication on or about October 25, 2023.

NRC Staff Held Information Gathering Public Meeting on the Fusion Systems Rulemaking On October 11, 2023, NRC staff held an Information Gathering public meeting with a Q&A session on the fusion systems rulemaking. The purpose of the meeting was to present the staffs preliminary proposed rule language for fusion systems and obtain feedback from stakeholders. The meeting was well attended by 180 individuals from academia, Agreement States, Federal agencies, fusion industry, Fusion Industry Association, international stakeholders, non-government organizations, a Tribal nation (Chickaloon Village Traditional Council, Alaska), and the NRC. Feedback mostly focused on fusion terminology, waste management, and environmental impacts. Additional public meetings on the preliminary proposed rule language for fusion systems are scheduled for November 1 and 9.

Office of Enforcement Items of Interest Week Ending October 13, 2023 DPO-2022-003, 50.72, 50.73 Reporting Requirements On July 19, 2023, the Regional Administrator (RA), Region III (RIII) issued a formal decision on a Differing Professional Opinion (DPO) submitted December 28, 2022, involving a disagreement on reporting in accordance with 10 CFR 50.72/50.73. The DPO stated that the RIII position that inoperability of the LaSalle County Generating Station (LaSalle), Unit 2 diesel generator supporting the High-Pressure Core Spray (HPCS) pump was NOT reportable was wrong; it was reportable even if the HPCS pump was operable. The DPO asserted past non-concurrence evaluations also got this wrong and the event was reportable. On July 6, 2023, an Ad Hoc Panel (DPO Panel) provided the results of its independent review of the DPO to the RA. The DPO Panel agreed with the submitter and concluded that the July 28, 2020, failure of the LaSalle Unit 2 Division 3 diesel generator (the only source of safety related power to the single train HPCS system) should have been reported. Additionally, the panel noted given the ambiguity in NRC guidance, lack of consistent previous enforcement, and low safety significance, the decision in this instance to decline to issue a notice of violation to LaSalle was reasonable. The RIII RA decision noted that it was more likely than not that a violation occurred, but based on the ambiguity in our guidance, no violation would be issued. Recommendations were provided to the program office to address these unique reporting situations.
