UNITED STATES STANDARD PRACTICE PROCEDURE PLAN FOR THE PROTECTION OF CLASSIFIED MATTER, AND LICENSE AMENDMENT REQUEST 22-03, LICENSING AMENDMENT FOR THE URENCO USA STANDARD PRACTICE PROCEDURE PLAN FOR THE PROTECTION OF CLASSIFIED MATTER

Dear Chris Schwarz:

By letters dated November 4, 2022, and February 3, 2023 (Agencywide Documents Access and Management System [ADAMS] Accession Nos. ML22311A536 and ML23034A237), Louisiana Energy Services (LES), LLC dba Urenco USA (UUSA), requested the U.S. Nuclear Regulatory Commission (NRC) approval of the Enrichment Technology Company-United States (ETC USA) Standard Practice Procedure Plan (SPPP) for the Protection of Classified Matter. The new SPPP will be added to the licensing basis documents listed in its materials license SNM-2010 as License Condition 10 ag.

By letter dated November 18, 2022 (ML22322A229), LES requested NRC approval of the UUSA SPPP for the Protection of Classified Matter. The new SPPP (Revision 19) would replace existing licensing basis documents listed in its materials license SNM-2010, License Condition 10.h.

The NRC staff has completed its review of the above submittals and find that the changes proposed are in accordance with the requirements of Title 10 of the Code of Federal Regulations (10 CFR) Section 95.15, and do not decrease the effectiveness of either SPPP.

Therefore, both license amendment requests 22-02 and 22-03 are approved and sub-paragraphs h and ag to License Condition 10 of SNM-2010 will be amended as follows:

Standard Practice Procedure Plan for the Protection of Classified Matter dated December 12, 2003, as revised by correspondence dated July 30, 2004; Enclosures 1, 2 and 4 transmitted by this letter contain Security Related Information. When separated from Enclosures 1, 2 and 4, this letter and Enclosure 3 are decontrolled.

The above changes are documented in Amendment 98 to LES Materials License SNM-2010 and are attached to this letter as Enclosures 3 and 4.

Because all the activities noted above involve administrative actions, the NRC staff determined that the proposed activities do not individually or cumulatively have a significant effect on the human environment. Therefore, in accordance with 10 CFR paragraph 51.22(c)(11), neither an Environmental Assessment nor an Environmental Impact Statement is warranted for this action.

In accordance with 10 CFR Part 2 Agency Rules of Practice and Procedure, a copy of this letter and Enclosure 3 will be available electronically for public inspection in the NRC Public Document Room (PDR) or from the Publicly Available Records component of NRCs ADAMS.
