ACCEPTANCE OF REQUEST FOR RENEWAL OF SPECIAL NUCLEAR MATERIALS LICENSE 2017 (ENTERPRISE PROJECT IDENTIFICATION NUMBER L-2021-RNW-0012)

Dear Benjamin Lewis:

On November 24, 2021, Sensor Concepts and Applications, Incorporated, (SCA) submitted an application to the U.S. Nuclear Regulatory Commission (NRC) for the renewal of Special Nuclear Material License Number 2017 (SNM-2017, ML22027A596). SCA requested that the SNM-2017 license be renewed for a period of 10 years. In its letter, SCA included a non-public version of its license renewal application (LRA).

The NRC staff conducted an acceptance review of SCAs LRA and, by letter dated February 9, 2022, (ML22042B309), accepted the LRA for technical review. The NRC staff published a notice in the Federal Register on March 7, 2022 (87 FR 12740), to provide the public with an opportunity to request a hearing and to petition for leave to intervene. However, no requests for a hearing or comments were received. During the conduct of the technical review of SCAs LRA the NRC staff determined that additional information was necessary, the NRC staff issued a request for additional information (RAI) to SCA. SCA provided its response to the RAI by letter dated May 28, 2022 (dated 2021), (ML22159A246). SCA provided additional detail to its license renewal application by letter dated September 22, 2022 (ML22276A223),

October 4, 2022, (ML2229A023), and November 17, 2022, (ML22333A720).

The NRC staff has completed its review of SCAs LRA, and as documented in the enclosed safety evaluation report (SER), found both the license renewal and the exemption request acceptable. Therefore, pursuant to title 10 of the Code of Federal Regulations (10 CFR) Part 70, Materials License SNM-2017 is renewed for a 10-year term that expires 10 years from the date of this letter.

The Enclosures to this letter contain Security-Related Information. When separated from Enclosures 1 and 3, this letter and Enclosures 2 and 4 are decontrolled.

Further, the NRC staff has granted SCA an exemption from the criticality alarm requirements in 10 CFR 70.24.

Enclosed are non-public (Enclosure 1) and public (Enclosure 2) versions of the renewed SNM-2017 license. The NRC staffs review of the LRA, the exemption request, and the staffs findings regarding issuance of the subject license and the exemption are documented in the NRC staffs SER. Enclosed are non-public (Enclosure 3) and public (Enclosure 4) versions of the SER.

As discussed in the SER, License Condition Number 9 of SNM-2017 is being revised to update the dates to reflect dates associated with this renewal. In addition, License Condition 12 of SNM- 2017 is being included to document the licensees exemption from the requirements of 10 CFR 70.24.

In accordance with 10 CFR 51.22(c)(14)(v) and 51.22(c)(25), the NRC staff reviewed the license application and exemption request and concluded that the proposed activities are categorically excluded from the requirements of 10 CFR Part 51, and do not require an environmental review.

In accordance with 10 CFR 2.390 of the NRCs Agency Rules of Practice and Procedure, a copy of this letter, without Enclosures 1 and 3, will be available electronically for public inspection in the NRC Public Document Room or from the Publicly Available Records component of ADAMS.
