APPROVAL OF URENCO USA COMPLIANCE PLAN FOR TITLE 32 OF THE CODE OF FEDERAL REGULATIONS PART 117 (ENTERPRISE PROJECT IDENTIFIER L-2021-SPR-0006)

Dear Wyatt Padgett:

The U.S. Nuclear Regulatory Commission (NRC) staff has reviewed your letter dated July 26, 2022 (Agencywide Documents Access and Management System [ADAMS] Accession No. ML22209A132). The Compliance Plan describes Urenco USA (UUSA) plans for coming into compliance with Title 32 of the Code of Federal Regulations (32 CFR) Part 117, National Industrial Security Program Operating Manual (NISPOM). UUSAs Compliance Plan was submitted in response to NRC correspondence dated June 1, 2022 (ML22144A408).

Subsequently, on September 13, 2022, the NRC issued a Request for Additional Information (ML22252A189). UUSA responded to the request on October 13, 2022 (ML22286A133) and submitted a revised Compliance Plan on December 14, 2022 (ML22348A162). After review of the additional information and revised Compliance Plan, the NRC staff has completed a security evaluation report which documents the review of the submittal.

The NRC staff has determined that the methods and procedures outlined in the UUSA Compliance Plan for the proposed updates will bring the Standards Practice Procedure Plan into compliance with 32 CFR Part 117 and will address the applicable portions consistent with the NRCs direction in the letter dated June 1, 2022 (ML22144A408). Therefore, NRC staff finds the final version of the Compliance Plan to be acceptable.

The two waivers UUSA requested are approved. Should UUSA continue to need a waiver past its expiration date, UUSA should request a new waiver from the NRC 60 days prior to its February 28, 2026, expiration.

The enclosure transmitted by this letter contains Security-Related Information.

When separated from the enclosure, this letter is decontrolled.
