UUSA Compliance with 32 CFR Part 117

Reference:

1) Materials License SNM-2010, License Condition 10 On December 21, 2020, the Department of Defense published the "National Industrial Security Program Operating Manual (NISPOM)" rule, Title 32 Code of Federal Regulations (CFR) Part 117, "National Industrial Security Program Operating Manual," in the Federal Register (85 FR 83312). The rule had an effective date of August 24, 2021.

Louisiana Energy Services LLC, dba Urenco USA (UUSA) met with NRC staff on March 29, 2022 to discuss our compliance with 32 CFR Part 117. UUSA intends to implement this regulation to the extent possible while continuing to meet 10 CFR 95. UUSA commits to performing the following actions.

1. Before October 31, 2022, UUSA will revise and submit to the NRC, Reference 1 Security Plan(s) that detail the methods UUSA uses to implement 10 CFR Part 95 requirements to include applicable subparts of 32 CFR Part 117 while continuing to implement 10 CFR Part 95.

2. For any applicable 32 CFR Part 117 subpart that cannot be fully implemented, UUSA will inform the NRC before September 31, 2022 our intention to request waivers in accordance with 32 CFR Part 117.7(n) and provide the target date for such submittal(s).
