SEQUOYAH NUCLEAR PLANT, UNITS 1 & 2 - SPECIAL INSPECTION REPORT 05000327/2022440 AND 05000328/2022440 AND APPARENT VIOLATION

Dear James Barstow:

On December 9, 2022, the U.S. Nuclear Regulatory Commission (NRC) completed a reactive inspection and discussed the results of this inspection with Mr. Thomas B. Marshall and other members of your staff. The results of this inspection are documented in the enclosed report.

The inspection commenced on December 7, 2022, in accordance with NRC Management Directive 8.3, NRC Incident Investigation Program, and Inspection Manual Chapter 0309, Reactive Inspection Decision Basis for Reactors, based on the initial risk and deterministic criteria evaluation made by the NRC on December 6, 2022.

The Special Inspection reviewed the circumstances surrounding events that occurred on December 5 and 6, 2022, and examined activities conducted under your license as they relate to safety, security, and compliance with the Commissions rules and regulations, and with the conditions of your license.

Section 93812 of the enclosed report discusses a finding with an associated apparent violation for which the NRC has not yet reached a preliminary significance determination.

The NRCs significance determination process (SDP) is designed to encourage an open dialogue between your staff and the NRC; however, neither the dialogue nor the written information you provide should affect the timeliness of our final determination. We ask that you promptly provide any relevant information that you would like us to consider in making our determination. We are currently evaluating the significance of this finding and will notify you in a separate correspondence once we have completed our preliminary significance review. You will be given an additional opportunity to provide additional information prior to our final significance determination unless our review concludes that the finding has very low safety significance (i.e.,

Green).January 17, 2023 In addition, one finding of very low security significance (Green) is documented in this report.

This finding involved a violation of NRC requirements. We are treating this violation as a non-cited violation (NCV) consistent with Section 2.3.2 of the Enforcement Policy.

If you contest the NCV or the significance of the NCV documented in this inspection report, you should provide a response within 30 days of the date of this inspection report, with the basis for your denial, to the U.S. Nuclear Regulatory Commission, ATTN: Document Control Desk, Washington, DC 20555-0001; with copies to the Regional Administrator, Region II; the Director, Office of Enforcement; the Director, Office of Nuclear Security and Incident Response; and the NRC Resident Inspector at Sequoyah Nuclear Plant, Units 1 and 2.

The following cross cutting aspect was assigned to the NCV using Inspection Manual Chapter 0310 Aspects Within Cross Cutting Areas: [H.2] - Field Presence.

If you disagree with the NCV cross-cutting aspect assignment in this report, you should provide a response within 30 days of the date of this inspection report, with the basis for your disagreement, to the U.S. Nuclear Regulatory Commission, ATTN: Document Control Desk, Washington, DC 20555-0001; with copies to the Regional Administrator, Region II; the Director, Office of Nuclear Security and Incident Response; and the NRC Resident Inspector at Sequoyah Nuclear Plant, Units 1 and 2.

This letter will be made available for public inspection and copying at http://www.nrc.gov/reading-rm/adams.html and at the NRC Public Document Room in accordance with Title 10 of the Code of Federal Regulations (10 CFR) 2.390, Public Inspections, Exemptions, Requests for Withholding.

The enclosed report contains Security-Related Information, so the enclosed report will not be made publicly available in accordance with 10 CFR 2.390(d)(1). If you choose to provide a response that contains Security-Related Information, please mark your entire response Security-Related Information-Withhold from public disclosure under 10 CFR 2.390 in accordance with 10 CFR 2.390(d)(1) and follow the instructions for withholding in 10 CFR 2.390(b)(1). The NRC is waiving the affidavit requirements for your response in accordance with 10 CFR 2.390(b)(1)(ii).
