By letter dated August 29, 2022 (Reference 1 ), Ameren Missouri submitted a license amendment request (LAR) to revise the Technical Specifications (TSs) to reflect an updated criticality safety evaluation for storage of spent fuel at Callaway Plant, Unit No. 1 (Callaway). By e-mail dated October 7, 2022 (Reference 2), the NRC staff requested supplemental information to support acceptance of the requested license amendment. to this letter contains sensitive information.

Specifically, the NRC staff concluded that the following information is necessary to enable the staff to make an independent assessment regarding the acceptability of the proposed amendment in terms of regulatory requirements for the protection of public health and safety and the environment.
The application does not have the proprietary sections identified in the proprietary attachment (Non-Public). In the non-proprietary (Public) version, the proprietary information is blackened out, instead of having blank spaces. Also, the application also does not have double brackets around the proprietary sections, with the codes specifying the reason for making the information proprietary. Moreover, the Affidavit provided is lacking in specificity. So essentially, the application is not meeting the requirements specified in 10 CFR 2.390, "Public inspections, exemptions, requests for withholding."
In Reference 2, it was stipulated that the information be provided by the mutually agreed date of October 26, 2022. This letter conveys the requested information in a manner conforming to the requirements of 10 CFR 2.390. Three enclosures are provided in this letter. Enclosure 1 provides the affidavits for withholding proprietary information from public disclosure. Enclosure 2 provides the non-proprietary version of the Criticality Safety Evaluation Report. Enclosure 3 provides the proprietary version of the Criticality Safety Evaluation Report.
Since Enclosure 3 contains information proprietary to HOLTEC International as well as contributors of technical content, Framatome, Inc. and Westinghouse Electric Company LLC, it is supported by an affidavit signed by a representative of the owners of the information. The affidavits set forth the basis on which the information may be withheld from public disclosure by the Commission and addresses with specificity the considerations listed in paragraph (b )( 4) of 10 CFR 2.390. Accordingly, it is respectfully requested that the proprietary information be withheld from public disclosure in accordance with 10 CFR 2.390.
The supplemental information provided in the enclosures to this letter has no impact on the changes requested and described in the LAR. As such, they do not change the "No Significant Hazards Consideration" conclusions reached in the LAR, nor do they change the conclusion regarding no need for an environmental assessment based on the categorical exclusion provisions of 10 CFR 51.22.
