SUMMARY

OF SEPTEMBER 13, 2022, PUBLIC MEETING WITH FLORIDA POWER AND LIGHT CONCERNING SUPPLEMENTAL INFORMATION NEEDED FOR ACCEPTANCE OF LICENSE AMENDMENT REQUEST TO REPLACE INSTRUMENTATION WITH DIGITAL SYSTEMS ON TURKEY POINT, UNITS 3 AND 4 (EPID L-2022-LLA-0105)

On September 13, 2022, the U.S. Nuclear Regulatory Commission (NRC) staff held a public meeting with the representatives of Florida Power & Light Company (the licensee; FPL) via video conference. The purpose of the meeting was to discuss the acceptance review of the planned digital instrumentation and control (DI&C) license amendment request (LAR) for Turkey Point Nuclear Generating Unit Nos. 3 and 4 (Turkey Point). The meeting notice and agenda are available in the Agencywide Documents Access and Management System (ADAMS) at Accession No. ML22251A365. The meeting was attended by over 70 stakeholders. A list of attendees is provided as an enclosure.

Meeting Summary By letter dated July 30, 2022, FPL submitted a LAR 274 for the Turkey Point to use digital instrumentation and controls (I&C) for the reactor protection system, engineered safety features actuation system, and nuclear instrumentation system. During the meeting, the NRC staff discussed the status and results of the LAR acceptance review including a discussion of acceptance review issues (information insufficiencies), potential review challenges, and other review topics to gain a better understanding of the LAR.

The NRC staff informed the licensee that it performs the acceptance review to determine if the LAR provides sufficient technical information in scope and depth to complete its detailed technical review. The acceptance review is also intended to identify whether the application has any readily apparent information insufficiencies in its characterization of the regulatory requirements or the licensing basis of the plant.

Acceptance Review Issues The NRC staff in its presentation to the licensee identified and discussed in detail the following five acceptance review issues which are sufficiency items, i.e., sufficient technical information in scope and depth is missing to allow the NRC staff perform safety reviews and make a reasonable assurance finding.

Environmental Qualification supplement - specific components and test summary reports Additional information for new system components previously not reviewed by NRC Human factor engineering verification and validation information including schedule Human factor engineering result summary reports including schedule Schedule of six implementation items identified by FPL LAR transmittal letter of July 30, 2022 The NRC staff also identified the following three technical areas as potential review challenges that would require additional technical basis to make a regulatory finding of reasonable assurance. However, the NRC staff clarified there were not sufficiency items needed to accept the application for review.

Level of detail of system requirement specification, Peer to peer network cross channel connectivity Communication interfaces to the distributed control system (DCS).

In addition, the NRC staff discussed the following four topics in detail to gain a better understanding of the design or approach in LAR to improve review efficiency.

Test Access Point (TAP) communications Self-Diagnostic function monitoring Accident dose consequence analysis Development schedule to facilitate planning of VOP audit activities Path Forward The NRC staff informed the licensee it would provide an opportunity to supplement the LAR prior to making its acceptance decision and that it will issue an opportunity to supplement letter to the licensee by September 16, 2022.

The NRC staff requested the licensee to provide specific description of and specific schedule for the five acceptance review issues (listed above), by October 5, 2022. This would enable the NRC staff to begin its detailed technical review. The NRC staff also emphasized that if the information responsive to the NRC staffs request is not received by the above date, the application will not be accepted for review pursuant to 10 CFR 2.101, and its activities associated with the application will cease. The NRC staff committed to issue its acceptance decision to the licensee by October 13, 2022.

The NRC staff informed the licensee that if the application is subsequently accepted for review, the licensee will be advised of any further information needed to support the staffs detailed technical review by separate correspondence. The licensee stated that it understands the NRC staffs request for supplemental information and will submit the supplemental information on the docket by October 5, 2022.

Conclusion At the end of the meeting, the NRC staff reiterated the path forward: the NRC staff will issue an opportunity to supplement letter to the licensee by September 16, 2022; the licensee will submit the supplemental information on the docket by October 5, 2022; and the NRC staff will issue its acceptance decision to the licensee by October 13, 2022.

NRC management gave closing remarks. No regulatory decisions were made during the meeting. Members of the public were in attendance. No comments or questions from the public were received during the meeting. No public meeting feedback forms were received.

After the public meeting, on September 15, 2022, the NRC staff issued an opportunity to supplement letter to the licensee (ADAMS ML22255A050).
