ACKNOWLEDGEMENT OF TEMPORARY SUSPENSION REQUEST FOR LICENSE AMENDMENT REQUEST REACTOR PROTECTION SYSTEM, ENGINEERED SAFETY FEATURES SYSTEM, AND NUCLEAR INSTRUMENTATION SYSTEM REPLACEMENT PROJECT (EPID L-2022-LLA-0105)

Dear Mr. Coffey:

By letter to the U.S. Nuclear Regulatory Commission (NRC) dated July30, 2022 (Agencywide Documents Access and Management System(ADAMS) Accession No. ML22214A076), as supplemented by letters dated August 19, 2022 (ML22235A670), October5,2022 (ML22278A075), January 17, 2023 (ML23017A225), February 10, 2023 (ML23041A340), and June 28, 2023 (ML23179A141), Florida Power & Light (FPL) submitted license amendment requests (LARs) for the Turkey Point Nuclear Generating Unit Nos. 3 and 4 (Turkey Point). The proposed license amendment request would permit the use of digital instrumentation and controls (I&C) for the reactor protection system, engineered safety features actuation system, and nuclear instrumentation system at Turkey Point.

In the letter dated June 28, 2023 (ML23179A141), FPL submitted a request to temporarily suspend the ongoing review of the Turkey Point digital I&C LARs. FPL notified the NRC of the need to reduce the scope of the LAR due to unforeseen material supply issues. This reduction in modification scope would significantly impact the LAR documents currently under review as well as those planned to be submitted. According to the letter, the requested suspension would remain in effect until further notice but would be expected to resume upon resubmittal of the revised LAR and supporting documents, tentatively scheduled for December 2023.

As of the date of this letter, the NRC staff has suspended further efforts supporting review of the Turkey Point LARs and closed the Enterprise Project Identifier L-2022-LLA-0105. The requested temporary suspension will remain in effect until further notice is receive from FPL. After FPL submits the revised Turkey Point digital I&C LARs, the NRC staff will develop new estimates for level-of-effort and review schedule to complete the review of the LARs.

Because FPL plans to restart the review with revised LARs, the NRC staff has taken actions to preserve the LARs analysis and assessment achieved to date. The staff has documented the review progress in a draft consolidated safety evaluation. The NRC staff will keep a copy of all the open items identified (including requested documents) by the NRC staff during the regulatory audit of the LARs. The NRC staff will keep a copy of all the draft, unsent requests for additional information. All the communication and coordination tools used during the NRC staffs review will be maintained.

To facilitate an effective and efficient restart of the NRC staffs review of the revised LARs, FPL should communicate with the NRC staff prior to requesting resumption of review activities. FPL plans to offer a pre-submittal meeting with the NRC to further discuss the final scope of modifications and LAR submittal. FPL intends to supplement the previously submitted documents in their entirety, along with description of the revised scope to facilitate NRC staff restart of the review of the LARs. The NRC recommends that FPL develops a roadmap (or some other tool) to indicate the changes in the revised LARs and parts of the revised LARs that have not been changed.
