THREE MILE ISLAND, UNIT 2 - REVIEW SCHEDULE FOR REQUESTED LICENSING ACTION REGARDING AMENDMENT REQUEST REVISION TO LICENSE CONDITION 2.C.(2) (EPID: L-2021-LLA-0103)

Dear John Sauger:

By letter dated May 13, 2021 (Agencywide Documents Access and Management System (ADAMS) Accession No. ML21144A262 (non-public) as supplemented on September 21, 2021 (ML21267A505), and on March 31 (ML22102A304), April 28 (ML22125A013), May 3 (non-public), May 9 (non-public), and May 10, 2022 (ML22131A138), EnergySolutions, LLC (ES) submitted a license application request seeking U.S. Nuclear Regulatory Commission (NRC) review and approval of modification to License Condition 2.C.(2) for the Three Mile Island, Unit 2 (TMI-2) license in support of the TMI-Station Independent Spent Fuel Installation Only Physical Security Plan. In the March 31 supplement, ES committed to providing the additional information by May 1, 2022 and stated that TMI-2 Solutions will develop a Security Plan document (its own plan).

On April 20, 2022 (ML22104A085), the NRC staff determined that the application was accepted for technical review contingent upon whether the May 1, 2022, submittals1 (referenced in the March 31, 2022, response) are of high quality. On April 28 (ML22125A013), ES provided a partial response and notified the NRC that its May 1, 2022, submittals would be submitted by May 3, 2022 and its response to the proposed license condition identified in the NRCs April 19, 2022 letter (ML22110A021), would be submitted by May 9, 2022. EnergySolutions provided its May submittals as indicted in its April 28 letter. On May 10, ES notified the staff of a typo in its May 9 submittal.

The NRC staff determined that your May submittals are of high quality. Therefore, the staff will begin its review on all parts of the application except for the review of the detailed description of the Physical Security responsibilities between Three Mile Island, Unit 1 (TMI-1) and TMI-2 that ES committed to submit by June 30, 2022. The NRC staff has established a detailed review for issuance of the final safety evaluation. The NRC staff expects to complete the license amendment review no later than September 1, 2022 (approximately 225 hours0.0026 days <br />0.0625 hours <br />3.720238e-4 weeks <br />8.56125e-5 months <br />), provided the 1 TMI-2 (ES) will provide a Supplement to the License Amendment Request Reference (3), by May 1, 2022.

Included in this submittal will be the following updated information: a. A description of the TMI-2 Security Plan and site implementation. b. The revised Title 10 of the Code of Federal Regulations (10 CFR) 73.67/Part 37 comparative analysis matrix to identify how requirements are met through implementation of a TMI-2 Plan implemented through a common site security plan. c. TMI-2 (ES) will revise the regulatory commitment table to reflect the TMI-1 & 2 common implementation of the security programs and update the regulatory table that reflects sole implementation by TMI-2.

J. Sauger ES submits the detailed description of the Physical Security responsibilities between TMI-1 and TMI-2 by June 30, 2022. If there are emergent complexities or challenges in our review, such as, multiple rounds of requests for additional information, or unanticipated addition of scope to the review that would cause changes to the initial forecasted completion date, the reasons for the changes, along with a new estimate, will be communicated during the routine interactions with the assigned project manager.

In accordance with 10 CFR 2.390 of the NRCs Agency Rules of Practice and Procedure, a copy of this letter will be available electronically for public inspection in the NRC Public Document Room or from the Publicly Available Records component of NRCs ADAMS.
