THREE MILE ISLAND, UNIT 2 - ACCEPTANCE OF REQUESTED LICENSING ACTION REGARDING AMENDMENT REQUEST REVISION TO LICENSE CONDITION 2.C.(2) (EPID: L-2021-LLA-0103)

Dear Mr. Sauger:

By letter dated May 13, 2021 (Agencywide Documents Access and Management System (ADAMS) Accession No. ML21144A262 (non-public)) as supplemented on September 21, 2021 (ADAMS Accession No. ML21267A505) and March 31, 2022 (ADAMS Accession No. ML22102A304), EnergySolutions, LLC (ES) submitted a license application request seeking U.S. Nuclear Regulatory Commission (NRC) review and approval of modification to License Condition 2.C.(2) for the Three Mile Island, Unit 2 license in support of the TMI-Station Independent Spent Fuel Storage Installation Only Physical Security Plan.

On March 31, 2022 (ADAMS Accession No. ML22102A304), ES submitted its response to the NRCs March 18, 2022, request for supplemental information (ADAMS Accession No. ML22108A096) and committed to submit all outstanding evaluations for this licensing proceeding by June 30, 2022.

The NRC determined that the application is accepted for technical review contingent upon whether your May 1, 2022, submittals1 (referenced in the March 31, 2022, response) are of high quality. If the staff determines your May 1, 2022, submittals are of high quality, the staff will begin its review on all parts of the application except for the review of the detailed description of the Physical Security responsibilities between TMI-1 and TMI-2 that ES committed to submit by June 30, 2022. It was the NRCs intention to issue a review schedule within 30 days of docketing your application. However, the supplemental information detailing the sharing of Physical Security responsibilities is needed in order to develop a complete and integrated review schedule. The NRC staff will establish a detailed review for issuance of the final safety evaluation report which will support making a final determination on your request after determining whether your May 1, 2022, submittals are of high quality.

1 TMI2S (ES) will provide a Supplement to the License Amendment Request Reference (3), by May 1, 2022. Included in this submittal will be the following updated information: a. A description of the TMI-2 Security Plan and site implementation. b. The revised 10 CFR 73.67/Part 37 comparative analysis matrix to identify how requirements are met through implementation of a TMI-2 Plan implemented through a common site security plan. c. TMI2S (ES) will revise the regulatory commitment table to reflect the TMI-1

& 2 common implementation of the security programs and update the regulatory table that reflects sole implementation by TMI-2.

We have established a partial schedule. If needed, we intend to have the Requests for Additional Information (RAIs) on the information submitted by May 1, 2022, in early June 2022 and are planning on obtaining ES Responses to the RAIs within 30 calendar days.
