Dear Daniel Harlan:

On July 29, 2021, Oregon State University (OSU) submitted an application to the U.S. Nuclear Regulatory Commission (NRC) for the renewal of Special Nuclear Material License Number 2013 (SNM-2013, ML21211A614). OSU requested that the SNM-2013 license be renewed for a period of 10 years. In its letter, OSU included a non-public version of its license renewal application (LRA). Subsequently, on July 31, 2021, OSU submitted a public version of its LRA (ML21235A325).

The NRC staff conducted an acceptance review of OSUs LRA and, by letter dated September 15, 2021 (ML21257A435), accepted the LRA for technical review. The NRC staff published a notice in the Federal Register on October 1, 2021 (86 FR 54485) to provide the public with an opportunity to request a hearing and to petition for leave to intervene. However, no requests for a hearing or comments were received. During the conduct of the technical review of OSUs LRA the NRC staff determined that additional information was necessary, and by letter dated October 29, 2021 (ML21300A112), the NRC staff issued a request for additional information (RAI) to OSU. OSU provided its response to the RAI by letter dated January 5, 2022, (ML22006A036). OSU subsequently supplemented its license renewal application by letter dated April 19, 2022, requesting an exemption under 10 CFR 70.17 from the criticality alarm requirements in Title 10 of the Code of Federal Regulations (10 CFR) 70.24, Criticality accident requirements. (ML22122A105).

The NRC staff has completed its review of OSUs LRA, and as documented in the enclosed safety evaluation report (SER), found both the license renewal and the exemption request acceptable. Therefore, pursuant to 10 CFR Part 70, Materials License SNM-2013 is renewed for a 10-year term that expires 10 years from the The Enclosures to this letter contain Security-Related Information. When separated from Enclosures 1 and 3, this letter and Enclosures 2 and 4 are decontrolled.

OSUs exemption request did not address the third criterion of the 10 CFR 70.17 exemption criteria, related to the public interest. In this instance, the NRC staff used its authority under 10 CFR 70.17 to fill in that information and grant the exemption. However, the NRC staff notes that use of this authority is intended to be an exception and that OSU should address all exemption criteria in any future requests.

Enclosed are non-public (Enclosure 1) and public (Enclosure 2) versions of the renewed SNM-2013 license. The NRC staffs review of the LRA, the exemption request, and the staffs findings regarding issuance of the subject license and the exemption are documented in the NRC staffs SER. Enclosed are non-public (Enclosure 3) and public (Enclosure 4) versions of the SER.

As discussed in the SER, License Condition Number 9 of SNM-2013 is being revised to update the dates to reflect dates associated with this renewal. In addition, License Condition 12 of SNM-2013 is being included to document the licensees exemption from the requirements of 10 CFR 70.24. Also, as discussed in the SER, the NRC staff is making an administrative change to License Condition 13 of SNM-2013 to update the name of the region IV division that OSU will notify at least 60 days prior to receipt of material.

In accordance with 10 CFR 51.22(c)(14)(v) and 51.22(c)(25), the NRC staff reviewed the license application and exemption request and concluded that the proposed activities are categorically excluded from the requirements of 10 CFR Part 51, and do not require an environmental review.

In accordance with 10 CFR Section 2.390 of the NRCs Agency Rules of Practice and Procedure, a copy of this letter, without Enclosures 1 and 3, will be available electronically for public inspection in the NRC Public Document Room or from the Publicly Available Records component of ADAMS.
