WESTINGHOUSE ELECTRIC COMPANY, LLC - AMENDMENT 26 TO MATERIAL LICENSE SNM-1107, EXEMPTION FOR ALTERNATE DISPOSAL OF SPECIFIC WASTE (ENTERPRISE PROJECT IDENTIFIER L-2021-LLA-0013)

Dear Ms. Malek:

In response to your letter dated February 8, 2021 (Agencywide Documents Access and Management System [ADAMS] Accession No. ML21039A719), and pursuant to Title 10 of the Code of Federal Regulations (10 CFR) Sections 20.2002, 70.11 and 30.11, the U.S. Nuclear Regulatory Commission (NRC) is granting an exemption from the requirements in 10 CFR 70.3 License requirements, and 10 CFR 30.3 Activities requiring license, and issuing a conforming license amendment to allow Westinghouse to transfer certain specific waste containing byproduct and special nuclear material for disposal to the US Ecology Idaho, Inc. RCRA Subtitle C disposal facility near Grand View, Idaho.

Safety Condition S-11 of your license is modified to include the new application date and states:

S-11 The licensee is granted an exemption from the requirements of 10 CFR 70.3 and 10 CFR 30.3, pursuant to 10 CFR 30.11 and 10 CFR 70.11, to allow it to transfer, for disposal, specific waste material from a) the East Lagoon, b) the East Lagoon liner, c) soils excavated from below the liner, solid CaF2 sludge previously dredged from the Calcium Fluoride Lagoons on the site and placed in a storage pile (all of this material is known to contain <0.5 weight percent U-235) and d) UF6 cylinders previously used for shipping that have gone through an internal wash/rinse process following their last use and are internally contaminated with SNM to the US Ecology Idaho, Inc. (USEI)

Resource Conservation and Recovery Act (RCRA) Subtitle C disposal facility near Grand View, Idaho as described in its submittals of May 8, 2020, September 22, 2020, October 12, 2020, and February 8, 2021 Condition 1 is also modified to reflect WECs submittal in association with this request. All other conditions of this license shall remain the same. The amended license, safety evaluation report, exemption notice, and environmental assessment (EA) are enclosed. The EA was published in the Federal Register on March11, 2021 (86 FR 13915). An exemption notice will also be Documents transmitted by this letter contain Security-Related Information.

When separated from Enclosure 3, this letter is decontrolled.
