WESTINGHOUSE ELECTRIC COMPANY, LLC - AMENDMENT 27 TO MATERIAL LICENSE SNM-1107, EXEMPTION OF TIME FOR LATE SHIPMENT NOTIFICATIONS (ENTERPRISE PROJECT IDENTIFIER L-2021-LLA-0013)

Dear Ms. Malek:

In your letter dated June 1, 2021, (Agencywide Documents Access and Management System (ADAMS) Accession No. ML21153A001), Westinghouse Electric Company, LLC (WEC) requested that the U.S. Nuclear Regulatory Commission (NRC) provide an exemption from certain requirements of Section III.E of Appendix G, Requirements for Transfers of Low-Level Radioactive Waste Intended for Disposal at Licensed Land Disposal Facilities and Manifests, of Title 10 of the Code of Federal Regulations (10 CFR) Part 20 for the Columbia Fuel Fabrication Facility (CFFF). The regulations in this section require Westinghouse to investigate and report to the NRC when Westinghouse does not receive notification of receipt of a shipment, or part of a shipment, of low-level radioactive waste within 20 days after transfer.

Westinghouse is requesting that the time period to receive acknowledgement that the shipment has been received by the intended recipient be extended from 20 days to 45 days for shipments by rail or mixed-mode shipments that involve rail. Westinghouse requested the exemption be approved for use for the duration of the license term, as reflected in the amended license.

As evaluated in the enclosed safety evaluation report, the NRC is approving this request, and making conforming changes to CFFFs license by adding a new license condition S-12.

Safety Condition S-12 will state:

The licensee is granted an exemption from 10 CFR 20, Appendix G, Section IIl.E.

Under the exemption, WEC is not required to report a low-activity radioactive material (containing byproduct or special nuclear material shipment) shipment sent Documents transmitted by this letter contain Security-Related Information.

When separated from Enclosure 3, this letter is decontrolled.

Malek 2 by rail or by mixed-mode including rail whose confirmation of delivery exceeds 20 days unless a copy of the signed NRC Form 540 (or NRC Form 540A, if required) acknowledging receipt has not been received within 45 days of the shipment leaving the CFFF facility as described in its submittal dated June 1, 2021. CFFF shall continue to utilize an electronic data tracking system interchange, or similar tracking system that allows monitoring the progress of the shipments on a daily basis for shipments subject to this exemption.

License Condition 1 is also modified to reflect WECs submittal in association with this request.

All other conditions of this license remain the same. The amended license and safety evaluation report are enclosed.

In accordance with 10 CFR Section 2.390 of the NRCs Agency Rules of Practice and Procedure, a copy of this letter will be available electronically for public inspection in the NRC Public Document Room or from ADAMS. ADAMS is accessible from the NRC Web site at http://www.nrc.gov/reading-rm/adams.html.
