LICENSE AMMENDMENT 15 - EXEMPTION FROM REPORTING CERTAIN UNPLANNED CONTAMINATION EVENTS - ENTERPRISE IDENTIFICATION NUMBER L-2020-LLA-0179

Dear Mr. Tate:

As requested in your letter dated August 3, 2019 (Agencywide Documents Access and Management System [ADAMS] Accession No. ML20216A611), supplemented by letter dated September 21, 2020 (ADAMS Accession No. ML20265A301), and pursuant to Title 10 of the Code of Federal Regulations (10 CFR) Part 70, Domestic Licensing of Special Nuclear Material, the U.S. Nuclear Regulatory Commission (NRC) is granting an exemption from the 24-hour reporting requirement in 10 CFR 70.50(b)(1).

Pursuant to 10 CFR Part 70, Special Nuclear Material License Number 1227 (SNM-1227) is hereby amended to add Safety Condition 7 as follows:

S-7 Notwithstanding the requirements of 10 CFR 70.50(b)(1), the licensee is exempted from the requirement to report unplanned contamination events when the following conditions are met:

1. The event occurs in a restricted area in a building which is maintained inaccessible to the public by multiple access controls,
2. The area was controlled for contamination before the event occurred, the release of radioactive material is under control, and no contamination has spread outside the area,
3. Radiation safety personnel trained in contamination control are readily available,
4. Equipment and facilities that may be needed for contamination control are readily available, and
5. The otherwise reportable unplanned contamination event is documented in the licensees Corrective Action Program.

Enclosure 3 transmitted by this letter contains Security-Related Information. When separated from the enclosure this letter is decontrolled.

OFFICIAL USE ONLY - SECURITY-RELATED INFORMATION T. Tate 2 The NRC staff safety evaluation report of your request for an exemption from the requirements in 10 CFR 70.50(b)(1) and the amended license are enclosed.

The NRC is also amending your license by deleting Safeguards Conditions 1.5 and 1.6 of SNM-1227. These license amendments documented the NRCs approval of your request, dated April 2, 2020 (ADAMS Accession No. ML20092N961), for a 30-day extension for submitting U.S. Department of Energy (DOE)/U.S. Nuclear Regulatory Commission (NRC) Form 742, Material Balance Report, DOE/NRC Form 742C, Physical Inventory Listing, per the requirements in Title 10 of the Code of Federal Regulations (10 CFR) Paragraph 75.35, and NRC Form 327, Special Nuclear Material (SNM) and Source Material (SM) Physical Inventory Summary Report, per the requirements in 10 CFR 74.17. By letter dated April 15, 2020 (ADAMS Accession No. ML20099D742), the NRC approved your request and issued Amendment 14 of SNM-1227 granting Framatome the following temporary exemptions:

SG-1.5 Notwithstanding the reporting requirement in 10 CFR 74.17, the licensee shall have until June 14, 2020, to submit the physical inventory summary reports (i.e., NRC Form 327, Special Nuclear Material (SNM) and Source Material (SM) Physical Inventory Summary Report) for the March 16, 2020, physical inventory.

SG-1.6 Notwithstanding the reporting requirement in 10 CFR 75.35, the licensee shall have until May 16, 2020, to submit the material status reports (i.e., DOE/NRC Form 742, Material Balance Report, DOE/NRC Form 742C, Physical Inventory Listing) for the March 16, 2020, physical inventory.

The NRC staff determined that both conditions are now expired and, therefore, are being deleted.

In accordance with 10 CFR, Section 2.390, Public inspections, exemptions, requests for withholding, of the NRCs Agency Rules of Practice and Procedure, a copy of this communication will be available electronically for public inspection in the NRC Public Document Room, or from the NRCs ADAMS. The ADAMS database is accessible from the NRC Web site at http://www.nrc.gov/reading-rm/adams.html.
