AMENDMENT 14 - APPROVAL OF EXEMPTION FROM TITLE 10 OF THE CODE OF FEDERAL REGULATIONS, PARAGRAPHS 74.17 AND 75.35 (ENTERPRISE IDENTIFICATION NUMBER L-2020-MCA-0002)

Dear Mr. Tate:

This is in response to your letter dated April 2, 2020 (Agencywide Documents Access and Management System [ADAMS] Accession Number ML20092N961). In your letter you requested the U.S. Nuclear Regulatory Commission (NRC) to grant a 30-day extension for submitting U.S. Department of Energy (DOE)/U.S. Nuclear Regulatory Commission (NRC) Form 742, Material Balance Report, DOE/NRC Form 742C, Physical Inventory Listing, per the requirements in Title 10 of the Code of Federal Regulations (10 CFR) Paragraph 75.35, and NRC Form 327, Special Nuclear Material (SNM) and Source Material (SM) Physical Inventory Summary Report, per the requirements in 10 CFR 74.17. In your letter, you stated that if the NRC grants your request, Framatome would submit DOE/NRC Forms 742 and 742C within 60 days of the start of inventory and NRC Form 327 within 90 days of the start of inventory. On April 2, 2020, you submitted an amended request (ADAMS Accession Number ML20093D162) addressing incorrect information provided in your April 2, 2020, letter.

The NRC staff has completed its review of your submittal. The NRC staff has concluded that granting the 30-day extension for completing and submitting the above referenced reports is in compliance with law, is consistent with safeguards agreements, and will not endanger life or property. The NRC staff also concluded that granting these exemptions is not inimical to the common defense and security and that it is in the public interest. As such, your request is approved. The NRC staff is temporarily exempting Framatome from the requirements in 10 CFR 74.17, in accordance with the requirements in 10 CFR 74.7, and from the requirements in 10 CFR 75.35, in accordance with the requirements in 10 CFR 75.3. As such, special nuclear materials license number 1227 (SNM-1227) is being amended by adding the following temporary Safeguards License Conditions under Section 1.0, Material Control and Accounting, of the SNM-1227 materials license:

OFFICIAL USE ONLYSECURITY-RELATED INFORMATION T. Tate 2 SG-1.5 Notwithstanding the reporting requirement in 10 CFR 74.17, the licensee shall have until June 14, 2020, to submit the physical inventory summary reports (i.e.,

NRC Form 327, Special Nuclear Material (SNM) and Source Material (SM)

Physical Inventory Summary Report) for the March 16, 2020, physical inventory.

SG-1.6 Notwithstanding the reporting requirement in 10 CFR 75.35, the licensee shall have until May 16, 2020, to submit the material status reports (i.e., DOE/NRC Form 742, Material Balance Report, DOE/NRC Form 742C, Physical Inventory Listing) for the March 16, 2020, physical inventory. of this communication provides Amendment 14 of SNM-1227 documenting these exemptions. This action closes efforts under Cost Activity Code/Enterprise Project Identifier 000224/07001257/L-2020-MCA-0002.

In accordance with 10 CFR, Section 2.390, Public inspections, exemptions, requests for withholding, of the NRCs Agency Rules of Practice and Procedure, a copy of this communication will be available electronically for public inspection in the NRC Public Document Room, or from the NRCs ADAMS.
