ACCEPTANCE FOR REVIEW OF FRAMATOME INC.S REQUEST FOR EXEMPTION FROM 24-HOUR REPORTING REQUIREMENT OF 10 CFR 70.50(B)(1) AND REQUEST FOR ADDITIONAL INFORMATION (ENTERPRISE PROJECT IDENTIFICATION NUMBER L-2020-LLA-0179)

Dear Mr. Tate:

The U.S. Nuclear Regulatory Commission (NRC) staff has received your submittal dated August 3, 2020 (Agencywide Documents Access and Management System (ADAMS)

Accession Number ML20216A611) requesting an exemption from the 24-hour reporting requirement in Title 10 of the Code of Federal Regulations (10 CFR) 70.50(b)(1) for situations that require the imposition of additional radiological controls for greater than 24 hours2.777778e-4 days <br />0.00667 hours <br />3.968254e-5 weeks <br />9.132e-6 months <br /> due to an unplanned contamination event inside an established contamination-controlled area.

We have completed our acceptance review and find your request acceptable for detailed review. However, we have identified additional information that is needed before final action can be taken.

The following information requested below should be provided within 30 days of the date of this letter:

Granting the requested exemption would require the NRC to make determinations in accordance with 10 CFR 70.17 which include, in part, finding that the exemption is in the public interest. Your application states the exemption would allow resources to be focused on other activities of higher significance or consequence. However, no data was provided to quantify the resources saved.

Granting the exemption would reduce the level of transparency to the public of unplanned contamination events. An estimate of the resources saved is needed to make a finding that a reduced level of transparency is justified. The resource estimate should be limited to costs incurred by reporting the event. Costs associated with investigations and corrective actions that would be performed even if no report was made should be excluded from the estimate.

Pending your response, we anticipate completing our review no later than January 15, 2021.

This date could change depending on the findings of our technical review, urgent assignments, or other factors. We will promptly communicate any significant changes to this schedule. In

T. Tate 2 addition, the NRC staff estimates that completing the review of your submittal will require approximately 50 staff hours which corresponds to about $13,950.00 ($279.00/hr).

In accordance with Title 10 of the Code of Federal Regulations, Section 2.390, Public inspections, exemptions, requests for withholding, of the NRCs Agency Rules of Practice and Procedure, a copy of this letter will be available electronically for public inspection in the NRC Public Document Room or from the Publicly Available Records component of the NRCs ADAMS.
