U.S. Nuclear Regulatory Commission Public Meeting Summary September 21, 2020

Title:

Public Meeting to Discuss Rulemaking to Incorporate by Reference American Society of Mechanical Engineers Codes into the U.S. Nuclear Regulatory Commission Regulations Meeting Identifier: 20200899 Date of Meeting: August 21, 2020 Location: Slide Presentation via WebEx and Operator-Assisted Bridge Line Type of Meeting: Category 3 Purpose of the Meeting(s):

The purpose of this meeting was to provide information about an upcoming proposed rule to incorporate by reference American Society of Mechanical Engineers (ASME) codes into the U.S. Nuclear Regulatory Commission (NRC) regulations, in Section 50.55a, Codes and standards, of Title 10 of the Code of Federal Regulations (10 CFR). Specifically, the NRC intends to incorporate by reference the 2019 Edition of the ASME Boiler and Pressure Vessel (BPV) Code Section III, Division 1 and Section XI, Division 1, and the 2020 Edition of Operation and Maintenance of Nuclear Power Plants, Division 1, OM Code: Section IST (OM Code).

The staff also provided an update on the status of the Approval of ASME Code Cases, Revision 39 proposed rule.

General Details:

The meeting was noticed on the NRC public website (see meeting notice and agenda listed under References below).

The meeting was scheduled from 10:00 a.m. - 12:00 p.m. and adjourned a few minutes early, after the conclusion of the question and answer period.

Representatives included participants attending the ASME Boiler and Pressure Vessel Code Week, representatives of licensees, vendors, and industry interest groups, and interested members of the public. In total, there were approximately 130 participants in this meeting.

A facilitated bridgeline was used to coordinate incoming feedback received from the attendees that participated by phone. A partial list of those attendees who logged into WebEx is provided as an attachment to this meeting summary.

Summary of NRC Presentation:

The meeting began with a discussion of the purpose and overview of the meeting. Next, information regarding the scope and schedule of the two 10 CFR 50.55a rulemakings were presented, after which detailed technical presentations were delivered by the NRC staff. After each presentation section, the NRC staff opened the meeting for questions and comments from the public, explaining that the comments and suggestions provided by the attendees would be considered in preparing the proposed rules, but that the staff would not prepare formal responses to such comments and questions. The NRC staff also encouraged the meeting participants to submit their comments on the docket during the public comment periods for the two rulemakings.

Ms. Victoria Huckabay, Project Manager, Division of Rulemaking, Environmental, and Financial Support, Office of Nuclear Materials Safety and Safeguards, provided opening remarks and presented information regarding the status of the 10 CFR 50.55a rulemakings. Ms. Huckabay provided an overview of the rulemaking process and discussed the timeline of the last several published Code Case and Code Edition and Addenda rulemakings. Ms. Huckabay noted that the ASME Code Case proposed rule is expected to be published in the Federal Register in the Fall 2020, and the ASME BPV/OM 2019-2020 Editions proposed rule is expected to be published in the Federal Register by the end of calendar year 2020.

The first technical presentation was provided by Dr. Chakrapani Basavaraju and focused on the incorporation by reference of the 2019 Edition of ASME BPV Code,Section III, Division 1.

The presentation included a discussion of a new proposed condition on Section III rules related to preservice inspection of steam generator tubes. The presentation also included a discussion on proposed revisions to four existing conditions on Section III rules.

The second presentation was provided by Mr. Raju Patel and focused on proposed revisions to two conditions related to Quality Assurance: one condition on Section III rules and another on Section XI rules.

The third presentation was provided by Mr. Keith Hoffman and focused on the incorporation by reference of the 2019 Edition of the ASME BPV Code,Section XI. The presentation discussed the staffs plans to revise six existing conditions on Section XI rules. The presentation also included a discussion of three new proposed conditions on Section III rules, including a condition stipulating regulatory submittal requirements for certain analyses, a condition regarding the use of subsequent editions and addenda with Code Cases, and a condition that addresses treatment of operational leakage. The presentation concluded with a discussion of the staffs plans to remove one exiting condition on Section XI rules.

In the fourth presentation, Mr. Robert Wolfgang provided a discussion focused on the incorporation by reference of the 2020 Edition of the ASME OM Code. The presentation discussed the staffs plans to remove the incorporation by reference of the 2011 Addenda and the 2015 Edition of the ASME OM Code and the corresponding revisions to existing conditions on the OM Code rules. The presentation also discussed the staffs plans to clarify the relationship between 10 CFR 50.55a(f)(4) and 10 CFR 50.55a(g)(4) regarding Inservice Testing and Inservice Inspection programs for snubbers. The staff also discussed the proposed addition of a new condition that would require applicants and licensees to submit IST Plans and interim IST Plan updates related to pumps and valves, and IST Plans and interim Plan updates related to snubber examination and testing, to the NRC. The presentation concluded with a discussion of a proposed relaxation of the interval for position verification testing for valves not susceptible to stem-disk separation.

Public Participation Comments and Questions:

After each section of the staffs presentation, members of the public in attendance were provided with an opportunity to ask questions and provide comments. Questions and comments were offered by industry stakeholders Gary Park of Iddeal Solutions, Thomas Basso of the Nuclear Energy Institute (NEI), Joe Weicks of Entergy, Daniel Lamond of True North Consulting, Scott Kulat of Inservice Engineering, Richard Deopere of Xcel Energy, Jim OSullivan of Pro-Con1, LLC, Mark DiRado of Exelon, Glen Palmer of Palmer Group International, LLC, Ron Lippy of True North Consulting, and Mark Gowin of Tennessee Valley Authority (TVA). They discussed several topics of interest and asked follow-up questions and provided comments related to the scope of the rulemakings, the rulemaking schedule, and specific aspects of the proposed changes discussed by the staff.

Questions and comments discussed by the public included, but not were not limited to, the proposed revision or deletion of the condition on pressure testing of mechanical joints, the applicability and use of the proposed new condition on operational leakage, condition (b)(2)(xxxii) regarding the submission of the summary report, the use of proposed new condition for handling Code Cases referencing later editions or addenda of the Code than the licensees Code of Record, use of the condition regarding mitigation of defects by modification, the applicability of clarifications to conditions (f)(4) and (g)(4) to snubbers, the timing of when the relaxation of the position verification testing may be implemented, the condition regarding the interim reporting of the IST Plans, and the timing of the IST program plan submittals.

The NRC staff expressed their appreciation for the stakeholder feedback provided during the meeting and encouraged the meeting participants to submit their comments during the public comment period for the forthcoming proposed rule.
