Acting on your appeal, I have. carefully reviewed the record in this case and have determined, for the reason stated below, that most of the documents can now be made publicly available. Therefore, your appeal is partially granted
-and partially denied.
The documents were originally denied because the NRC was taking enforcement .
action, independent of the D0J action, against the Sacramento Municipal Utility i District (SMUD). A civil penalty in the amount of $100,000 was imposed, and on i February. 13, 1989 SMUD paid the penalty. In light of this, Exemption (7)(A) is no longer applicable. With one minor deletion, the 35 documents listed on i the enclosed Appendix A can now be made publicly available and are enclosed, l A date of birth has been deleted from page 4 of the document identified at number 30 on the enclosed Appendix A. This information is being withheld from public disclosure pursuant to Exemption (6) of the F0IA (5 U.S.C. 552(b)(6))
and 10 CFR 9.17(a)(6) of the Commission's regulations. I am unable to identify ,
any legitimate public interest in the release of this information which outweighs the privacy interest of the individual.
The 13 documents listed on the enclosed Appendix B have been referred to SMUD for review to help NRC determine if any information contained in the documents isconfidentialbusiness(proprietary)information. When NRC receives the results of that review, we will communicate with you further concerning our determination on those documents. ;
