The U.S. Nuclear Regulatory Commission (NRC, the Commission) has issued the enclosed Amendment No. 202 to Renewed Facility Operating License No. NPF-47 for River Bend Station, Unit 1 (River Bend). The amendment consists of changes to the River Bend Technical Specifications (TSs) in response to your application dated November 18, 2019 (Agencywide Documents Access and Management System Accession No. ML19322C569).

The amendment modifies River Bend TS 3.3.5.2, Reactor Pressure Vessel (RPV) Water Inventory Control Instrumentation, by removing the surveillance frequencies and placing them in a licensee-controlled program through the adoption of Technical Specifications Task Force (TSTF) Traveler, TSTF-425, Revision 3, Relocate Surveillance Frequencies to Licensee Control - RITSTF [Risk-Informed Technical Specification Task Force] Initiative 5b, which was approved by the NRC on April 29, 2019, for adoption into the River Bend TSs.

A copy of the related safety evaluation is also enclosed. Notice of Issuance will be included in the Commissions Federal Register notice.

1. The Nuclear Regulatory Commission (the Commission) has found that:

A. The application for amendment by Entergy Operations, Inc. (the licensee), dated November 18, 2019, complies with the standards and requirements of the Atomic Energy Act of 1954, as amended (the Act), and the Commissions rules and regulations set forth in 10 CFR Chapter I; B. The facility will operate in conformity with the application, as amended, the provisions of the Act, and the rules and regulations of the Commission; C. There is reasonable assurance (i) that the activities authorized by this amendment can be conducted without endangering the health and safety of the public, and (ii) that such activities will be conducted in compliance with the Commissions regulations; D. The issuance of this amendment will not be inimical to the common defense and security or to the health and safety of the public; and E. The issuance of this amendment is in accordance with 10 CFR Part 51 of the Commissions regulations and all applicable requirements have been satisfied.

2. Accordingly, the license is amended by changes to the Technical Specifications as indicated in the attachment to this license amendment, and paragraph 2.c.(2) of Renewed Facility Operating License No. NPF-47 is hereby amended to read as follows:

(2) Technical Specifications and Environmental Protection Plan The Technical Specifications contained in Appendix A, as revised through Amendment No. 202 and the Environmental Protection Plan contained in Appendix B, are hereby incorporated in the renewed license. EOI shall operate the facility in accordance with the Technical Specifications and the Environmental Protection Plan.

3. This amendment is effective as of its date of issuance and shall be implemented within 90 days from the date of issuance.

ATTACHMENT TO LICENSE AMENDMENT NO. 202 RENEWED FACILITY OPERATING LICENSE NO. NPF-47 RIVER BEND STATION, UNIT 1 DOCKET NO. 50-458 Replace the following pages of the Renewed Facility Operating License No. NPF-47 and Appendix A Technical Specifications with the attached revised pages. The revised pages are identified by amendment number and contain a marginal line indicating the area of change.

(2) EOI, pursuant to Section 103 of the Act and 10 CFR Part 50, to possess, use and operate the facility at the above designated location in accordance with the procedures and limitations set forth in this renewed license; (3) EOI, pursuant to Section 103 of the Act and 10 CFR Part 70, to receive, possess and to use at any time special nuclear material as reactor fuel, in accordance with the limitations for storage and amounts required for reactor operation, as described in the Final Safety Analysis Report, as supplemented and amended; (4) EOI, pursuant to Section 103 of the Act and 10 CFR Parts 30, 40 and 70, to receive, possess, and use at any time any byproduct, source and special nuclear material as sealed neutron sources for reactor startup, sealed sources for reactor instrumentation and radiation monitoring equipment calibration, and as fission detectors in amounts as required; (5) EOI, pursuant to Section 103 of the Act and 10 CFR Parts 30, 40 and 70, to receive, possess, and use in amounts as required any byproduct, source or special nuclear material without restriction to chemical or physical form, for sample analysis or instrument calibration or associated with radioactive apparatus or components; and (6) EOI, pursuant to Section 103 of the Act and 10 CFR Parts 30, 40 and 70, to possess, but not separate, such byproduct and special nuclear materials as may be produced by the operation of the facility.

C. This renewed license shall be deemed to contain and is subject to the conditions specified in the Commissions regulations set forth in 10 CFR Chapter I and is subject to all applicable provisions of the Act and the rules, regulations and orders of the Commission now or hereafter in effect; and is subject to the additional conditions specified or incorporated below:

(1) Maximum Power Level EOI is authorized to operate the facility at reactor core power levels not in excess of 3091 megawatts thermal (100% rated power) in accordance with the conditions specified herein.

(2) Technical Specifications and Environmental Protection Plan The Technical Specifications contained in Appendix A, as revised through Amendment No. 202 and the Environmental Protection Plan contained in Appendix B, are hereby incorporated in the renewed license. EOI shall operate the facility in accordance with the Technical Specifications and the Environmental Protection Plan.

SAFETY EVALUATION BY THE OFFICE OF NUCLEAR REACTOR REGULATION RELATED TO AMENDMENT NO. 202 TO RENEWED FACILITY OPERATING LICENSE NO. NPF-47 ENTERGY OPERATIONS, INC.

RIVER BEND STATION, UNIT 1 DOCKET NO. 50-458

1.0 INTRODUCTION

By application dated November 18, 2019 (Agencywide Documents Access and Management System (ADAMS) Accession No. ML19322C569), Entergy Operations, Inc. (Entergy, the licensee) submitted a request for changes to the Technical Specifications (TSs) for River Bend Station, Unit 1 (River Bend).

The proposed amendment would modify River Bend TS 3.3.5.2, Reactor Pressure Vessel (RPV) Water Inventory Control Instrumentation, by removing the surveillance frequencies and placing them in a licensee-controlled program through the adoption of Technical Specifications Task Force (TSTF) Traveler, TSTF-425, Revision 3, Relocate Surveillance Frequencies to Licensee Control - RITSTF [Risk-Informed Technical Specification Task Force] Initiative 5b.

Background

By letter dated April 29, 2019 (ADAMS Accession No. ML19066A008), the U.S. Nuclear Regulatory Commission (NRC, the Commission) approved License Amendment No. 196 concerning the adoption of TSTF-425, Revision 3, into the River Bend TSs. Prior to final approval, Entergy submitted a supplement dated December 20, 2018 (ADAMS Accession No. ML19002A115) to the River Bend TSTF-425, Revision 3, license amendment request that provided revised marked-up TS pages. These revised marked-up TS pages incorporated the changes approved in Amendment No. 193, dated November 7, 2018 (ADAMS Accession No. ML18267A341), which adopted TSTF-542, Reactor Pressure Vessel Water Inventory Control. However, the licensees supplement inadvertently omitted a revised markup of TS page 3.3-43c for new TS 3.3.5.2 surveillance requirements (SRs).

2.0 REGULATORY EVALUATION

2.1 Description of the Proposed Change The licensee proposed to modify the TSs by relocating the surveillance frequencies for SRs 3.3.5.2.1, 3.3.5.2.2, and 3.3.5.2.3 to a licensee-controlled program described in TS 5.5.12 Enclosure 2

Surveillance Frequency Control Program (SFCP), through the adoption of TSTF-425, Revision 3.

2.2 Applicable Regulations In Title 10 of the Code of Federal Regulations (10 CFR) 50.36, Technical specifications, the NRC established regulatory requirements related to the content of TSs. Pursuant to 10 CFR 50.36, TSs are required to include items in the following five specific categories related to station operation: (1) safety limits, limiting safety system settings, and limiting control settings; (2) limiting conditions for operation; (3) SRs; (4) design features; and (5) administrative controls.

Section 50.36(c)(3), Surveillance requirements, of 10 CFR states:

Surveillance requirements are requirements relating to test, calibration, or inspection to assure that the necessary quality of systems and components is maintained, that facility operation will be within safety limits, and that the limiting conditions for operation will be met.

3.0 TECHNICAL EVALUATION

The NRC staff reviewed the proposed change to relocate the surveillance frequencies for SRs 3.3.5.2.1, 3.3.5.2.2, and 3.3.5.2.3 to the SFCP.

The NRC staff finds the proposed change acceptable because relocating the surveillance frequencies to the SFCP meets the intent of TSTF-425, Revision 3. SRs 3.3.5.2.1, 3.3.5.2.2, and 3.3.5.2.3 have fixed periodic frequencies and do not meet the exclusion criteria identified in the NRC staffs model safety evaluation dated July 6, 2009 (74 FR 31996; ADAMS Accession No. ML090900716).

Changes to the frequencies for these SRs will be controlled under the SFCP in accordance with TSTF-425, Revision 3. The SFCP provides the necessary administrative controls to ensure that SRs related to testing, calibration, and inspection are conducted at frequencies necessary to assure that the quality of systems and components is maintained, that facility operation will be within safety limits, and that the limiting conditions for operation will be met.

Based on the above evaluation, the NRC staff concludes that, with the proposed relocation of the surveillance frequencies to a licensee-controlled program and administratively controlling the program in accordance with the TSs, the licensee continues to meet the requirements in 10 CFR 50.36.

4.0 STATE CONSULTATION

In accordance with the Commissions regulations, the Louisiana State official was notified of the proposed issuance of the amendment on August 21, 2020. The State official had no comments.

5.0 ENVIRONMENTAL CONSIDERATION

The amendment changes a requirement with respect to the installation or use of a facility component located within the restricted area as defined in 10 CFR Part 20 and changes SRs.

The NRC staff has determined that the amendment involves no significant increase in the

amounts, and no significant change in the types, of any effluents that may be released offsite, and that there is no significant increase in individual or cumulative occupational radiation exposure. The NRC has previously issued a proposed finding that the amendment involves no significant hazards consideration, published in the Federal Register on March 10, 2020 (85 FR 13951, and there has been no public comment on such finding). Accordingly, the amendment meets the eligibility criteria for categorical exclusion set forth in 10 CFR 51.22(c)(9).

Pursuant to 10 CFR 51.22(b), no environmental impact statement or environmental assessment need be prepared in connection with the issuance of the amendment.

6.0 CONCLUSION

The Commission has concluded, based on the considerations discussed above, that: (1) there is reasonable assurance that the health and safety of the public will not be endangered by operation in the proposed manner, (2) there is reasonable assurance that such activities will be conducted in compliance with the Commissions regulations, and (3) the issuance of the amendment will not be inimical to the common defense and security or to the health and safety of the public.
