RE Request for information under the Freedom of Information Act

Dear Ms. Brown,

By this letter on behalf of the federal 501(c)(3), norFprofit, educational i environmental group, Citizens Awareness Network, Inc.(CAN), CAN requests the release of information under the Freedom of Information Act. CAN is engaged in a project which is intended to show the public how our govemment agencies really work-a sort of 6 inner-workingsd of govemment revealed publication I project. CAN intends to publish and distribute a small pamphlet once we have .

put together the necessary information. As part of this project, CAN wants to know more about the relationship between the NRC and the industry it regulates. Release of the following information will further these educational purposes.

As a non profit, educational organization working to help citizens understand the inner-workings of govemment, CAN should be entitled to access to the below requested information at little or no cost.

, Pursuant to the Freedom of Information Act, CAN hereby requests that your l agency provide the following information:

Request no.1 During the period from January 1,1992 through the time this request is filled, please provide copies of any and all e-mails (and any other electronic, digital, or magnetic information/ data storage system); telephone logs, notes of telephone or telephonic communications; personallogs, joumals, notes, memoranda to file, letters, faxes, fax logs, magnetic disk 9809020081 980827 PDR FOIA BLOCK 98-175 PDR 9 w90 ac os t 7/t.

4 files or other data files of any and all communications between attorneys for Yankee Atomic Electric Company (and/or investigators and/or agents employed by Yankee Atomic Electric Company) and (1) Morton Fairtile, (2) Seymour Weiss, (3) Michael Masnick, (4) any person employed by the NRC in the Office of General Counsel, discussing any issues related to decommissioning and license termination at the following nuclear power stations: Yankee, Trojan, Connecticut Yankee (Haddam Neck), Maine Yankee, Vermont Yankee, as well as any discussions or writings by the named persons conceming the extension of Part 50 licenses, spent fuel storage on site under a Part 50 or Part 72 license, avoidance of Part 50 or Part 72 license fees, changes in decommissioning rules, methods of controlling public meetings, methods of affecting the outcome of public meetings, the use of No Significant Hazards Consideration.

This request should be interpreted to include as well copies of any like communications by the supervisors, superiors, or predecessors of the described NRC staff persons which have been communicated to the described staff persons.

During the period from January 1,1992, through the time this request is filled, copies of any and all e-mails (and any other electronic, digital, or magnetic information/ data storage system); telephone logs; notes of telephone or telephonic communications; personal logs, joumals, notes, memoranda to file, letters, faxes, fax logs, magnetic disk files or other data files of any and all communications between (1) the Nuclear Energy Institute; (2) the Eagle Alliance (and/or investigators and/or agents employed by these persons) and (1) Morton Fairtile, (2) Seymour Weiss, (3) Michael Masnick, (4) any person employed by the NRC in the Office of General Counsel, discussing any issues related to decommissioning and license termination at the following nuclear power stations: Yankee, Trojan, Connecticut Yankee (Haddam Neck), Maine Yankee, Vermoht Yankee, as well as any discussions conceming the extension of Part 50 licenses, spent fuel storage under a Part 50 or Part 72 license, avoidance of Part 50 or Part 72 license fees, changes in decommissioning rules, methods of controlling public meetings or affecting the outcome of public meetings, and the used of No Significant Hazards Consideration, and license termination plans.
