NOTICE OF VIOLATION (NRC Inspection Reports 50-219/88-23 and 50-219/88-80)

This refers to the NRC resident inspection conducted on July 31 - September 10,

1988, as well as the Augmented Team Inspection conducted between October 13-18,

1988, concerning problems associated with the isolation condensers at the Oyster

'

Creek Nuclear Generator Station. The inspection reports were sent to you on Sep-

'

tember 29 and October 31, 1988 respectively.

This also refers to your letter dated

,

December 28, 1988, which provided your analysis of the effects of noncondensible

gases on performance of the isolation condensers.

During the inspections as well

i

as through our analysis of your December 28 letter, a violation of NRC requirements

was identified. On November 17, 1988, an Enforcement Conference was conducted with

you and members of your staff to discuss the violation, its cause, and your cor-

rective actions.

The violation, which is described in the enclosed Notice, involves inadequacies

in a surveillance test procedure which resulted in a valve being mispositioned.

The violation is of low safety significance because the isolation condensers were

not made inoperable by this event.

Therefore, the violation is classified at

Severity Level IV in accordance with the " General Statement of Policy and Procedure

for NRC Enforcement Actions," 10 CFR Part 2, Appendix C (1988) (Enforcement Policy).

The underlying problem identified in the violation is of particular concern to the

NRC because of previous problems with procedures which have occurred during the

past two years which caused or contributed to the following events: a Safety Limit

Violation, declaration of the Containment Spray / Emergency Service Water System Loop

I inoperable and exceeding a Technical Specification Limiting Condition for Opera-

tion, and the development of freezing conditions in the reactor building which

resulted in erratic pressure indication on recirculation pump seals.

These defi-

ciencies demonstre.te the importance of ensuring that facility procedures are ade-

quate. Therefore, we emphasize that similar violations in the future may result

in escalated enforcement action.

you should document the specific actions taken and any additional actions you plan

to prevent recurrence. After reviewing your response to this Notice, including

your proposed corrective actions and the results of future inspections, the NRC

will determine whether further NRC enforcement action is necessary to ensure com-

pliance with NRC regulatory requirements.

In accordance with Section 2.790 of the NRC's " Rules of Practice," Part 2, Title

10, Code of Federal Regulations, a copy of this letter and its enclosure will be

placed in the NRC Public Document Room.

The responses directed by this letter and the enclosed Notice are not subject to

the clearance procedures of the Office of Management and Budget as required by the

Paperwork Reduction Act of 1980, Pub. L. No.96-511.
