Dear Ms. Garde:

This is in further response to your letter dated June 25, 1986, in which you appealed Mr. Donnie H. Grimsley's letter dated May 27, 1986.

Mr. Grimsley's letter denied documents in whole or in part that were subject to your Freedom of Information Act (F0IA) request for documents a related to the NRC Comanche Peak Task Force. My letter to you dated April 10,1987, addressed the agreement which was the basis for deleting certain information in the requested documents. This letter addresses those entire nine documents and the portions of 84 documents listed on Appendices K and L which were initially denied pursuant to F0IA exemptions.. This letter also addresses additional documents, K-111 and L-263, for which Mr. Grimsley's letter dated May 27, 1986, failed to indicate that portions of the documents were withheld from public disclosure pursuant to Exemption (5) of the F0IA. For your information, document K-241 was placed in the NRC Public Document Room among the documents disclosed in Mr. Grimsley's letter dated May 27, 1986.

Acting on your appeal, I have carefully reviewed the record in this case and have determined that document K-396 in its entirety and portions of documents K-301 through K-307 can now be made publicly available. This information is enclosed. I have also determined that the previously l withheld information in whole or in part in seven documents will continue I to be withheld from public disclosure pursuant to Exemption (4) of the l F0IA (5 U.S.C. 552(b)(4)) and 86 documents will continue to be withheld f from public disclosure pursuant to Exemption (5) of the FOIA (5 U.S.C.

L 552(b)(5)) and 10 CFR 9.5(a)(4) and (5) of the Comission's l

regulations. Your appeal is, therefore, partially granted and partially '

i denied.

The withheld portions of documents K-301 through K-307 contain the tests and procedures required for the Brand Industrial Services, Inc. (BISCO)

! to successfully complete the installation of penetration seals at a nuclear power facility. BISCO considers this information to be commercial (proprietary) infonnation the disclosure of which would harm its competitive position.

As stated in Mr. Grimsley's letter dated May 27, 1986, the withheld information, in whole or in part, in 86 documents relates to the subject of potential violations. The withheld portions were predecisional to the issuing of the enforcement action on Comanche Peak. Exemption (5) shields from mandatory disclosure information generated in the I

deliberative process that precedes most decisions of government agencies.

.This is in further response to your letter dated January 21, 1985, in which you requested, pursuant to the Freedom of Information Act (F0IA), records related to the NRC Comanche Peak Task Force established in March 1984. .

We'are now placing two boxes of records (boxes two and three) in'the mechanical / piping category in the NRC Public Document Room (PDR) in file F01A-85-59 under your name. In particular, with the exception of those records indicated by asterisks on the enclosed Appendices K and L, which are i

undergoing further staff review, we are making available for public inspection -

and copying at the PDR the 420 records listed on the enclosed Appendix K and the 360 records listed on the enclosed Appendix L. ,

With regard to records identified on Appendix K, the records identified at numbers 301 through 307 and 396 are being withheld from public disclosure pursuant to Exemption ~(4) of'the F0IA (5 U.S.C. 552(b)(4)) and 10 CFR 9.5(a)(4) of the Comission's regulations because they contain comercial information provided in confidence to the NRC. The record identified at number 420 and portions of the records identified at numbers 5 through 7, 9 through 15, 21 through 23, 25 through 28, 55 through 62, 88 through 96, 116, 117, 119 through 123, 143 through 148, 176 through 179, 196, 207, 241, 258, 259, 268, and 290 are being withheld from public disclosure pursuant to Exemption (5) of the FOIA (5 U.S.C. 552(b)(5)) and 10 CFR 9.5(a)(5) of the Comission's regulations. The withheld portions contain the advice, opinions, and recommendations of the staff concerning potential violations. The nonexempt portions of the Appendix K records are being placed in PDR file F01A-85-59 under your name.

In accordance with the agreement reached between you and the NRC staff at a

The information not disclosed, without invocation of an F0IA exemption, consists of names and other identifying information concerning allegers, interviewees, and other individuals.

Pursuant to 10 CFR 9.9 of the Commission's regulations, it has been determined that the information withheld pursuant to Exemptions (4) and (5) of the F0IA is exempt from production or disclosure and that its production or disclosure is contrary to the public interest. The persons responsible for this denial are the undersigned and Mr. Harold R. Denton, Director, Office of Nuclear Reactor Regulation.

This denial may be appealed to the Executive Director for Operations within 30 days from the receipt of this letter. Any such appeal must be in writing, I addressed to the Executive Director for Operations, U.S. Nuclear Regulatory Commission, Washington, DC 20555, and should clearly state on the envelope and in the letter that it is an " Appeal from an Initial FOIA Decision."

A separate set of the released records is being made available for public inspection and copying at the Local Public Document Room (LPDR) located at the University of Texas Library, 170 South Cooper Street, Arlington, Texas.

Additional boxes of records subject to your request are currently under review and will be placed in the POR and LPDR in the coming weeks.
