NOTICES OF VIOLATION

Dear Mr. Miller:

The purpose of this letter is to issue the enclosed Notices of Violation (Notices) identifying that the Safety Analysis Update (SARUP) submittals for the Paducah (PGDP) and Portsmouth (PORTS) Gaseous Diffusion Plants did not meet the requirements identified in the compliance plans for these facilities.

The violations are cited against the PGDP and PORTS Certificates of Compliance Condition 8 which requires U.S. Enrichment Corporation (USEC) to conduct operations in accordance with the compliance plan for both facilities. Compliance Plan issue 2," Update the Application Safety Analysis Report (SAR)," for both PGDP and PORTS requires that the August 18,1997, submittal include proposed modifications to the Application SAR and proposed modification to the Application Technical Safety Requirements (TSRs). The submittals for PGDP and PORTS did not include these required proposed modifications, most noteworthy of the missing modifications were Chapter 3 and the TSRs. Rather, the cover letters for the submittals stated that these modifications would be submitted by October 31,1997, except for Chapter 3 for which you proposed a schedule showing a completed submittai date of October 31,2000.

The U.S. Nuclear Regulatory Commission is concerned that the Compliance Plan dates have not been met. USEC, as the docketed certificate holder, has sole responsibility to ensure the accuracy and timeliness of the Application SAR. USEC should prioritize, based on potential safety consequences, confirmatory walkdowns concerning the Chapter 3 SAR submittal and resultant Chapter 3 upgrade modifications.

The NRC has concluded that information regarding the reason for the violations, the corrective actions taken and planned to correct the violations and prevent recurrence are adequately addressed on the docket in your letter dated December 24,1997, to Dr. Carl J. Paperiello. \ \

However, you are required to provide a detailed schedule and plan for completion of Chapter 3 upgrades within 30 days from the date of this letter, in addition, any resultant changes to the Chapter 4 accident analysis, including additional compensatory measures, that you identify as D(O having a significant implication for public health and safety or common defense and security, must be communicated to the NRC in accordance with 10 CFR 76.9 (b). All other changes affecting Chapter 4 should be communicated to the NRC within 30 days of the date that you
