s ENCLOSURE 1 NOTICE OF VIOLATION Duke Power Company Docket No.

50-413 Catawba License No. NPF-35 During the Nuclear Regulatory Commission (NRC) inspection conducted on October 26 - November 25, 1986, a violation of NRC requirements was identified.

The violation involved testing of the IB diesel generator load sequencer panel without the use of a station management approved procedure and failure to perform a safety evaluation prior to conducting the test.

In accordance with the

" General Statement of ~ Policy and Procedure for NRC Enforcement Actions,"

10 CFR Part 2, Appendix C (1985), the violation is listed below:

Technical Specification 6.8.1 requires procedures to be established and implemented for work on safety-related equipment.

Technical Specifica-tion 6.8.2 requires each procedure of Specification 6.8.1 to be reviewed and approved by station management prior to implementation.

10 CFR 50.59(b) requires that a written safety evaluation be performed, which provides the bases for the determination that a change, test or experiment does not involve an unreviewed safety question.

Contrary to the above, on October 24, 1986, while IB diesel generator was declared operable, low level vibrational testing was conducted on the IB diesel generator safety related load sequencer panel without the existence of a station management approved procedure and a safety evaluation had not been performed.

This is a Severity Level IV Violation (Supplement I). This violation is applicable to Unit 1 only.

Pursuant to the provisions of 10 CFR 2.201, Duke Power Company is hereby required to submit to this Office within thirty (30) days of the date of the letter transmitting this Notice a written statement or explanation in reply including :

(1) admission or denial of the violations, (2) the reason for the violation if admitted, (3) the corrective steps which have been taken and the results achieved, (4) the corrective steps which will be taken to avoid further violations, and (5) the date when full compliance will be achieved. Where good cause is shown, consideration will be given to extending the response time.
