Dear Congressman Thomas:
I am responding to your November 14, 1983 letter to Chairman Parladino regarding the Commission's schedule and procedures for future licensing decisions for Diablo Canyon Nuclear Power Plant, Unit 1.
As you noted, the Commission recently authorized fuel loading and pre-criticality testing at Diablo Canyon, lifting in part.the suspension imposed in November 1981.
The licensee, Pacific Gas and Electric Company (PG&E), ' estimates that it will require approximately 45 days to conduct the activities now authorized.
Meanwhile, the NRC's Atomic Safety and Licensing Appeal Board is holding hearings on design quality assurance in California.
These hearings should be completed by Novem-ber 23, 1983, though the Appeal Board decision could not be expected before mid-to-late January, 1984.
i The Commission has not yet established a schedule or proce-dures for future licensing decisions for Diablo Canyon.
Initially, PG&E must request further authorization, probably to take the plant to criticality and conduct low-power tests.
We expect PG&E's next request will be submitted in the near' future.
The NRC staff will review issues material I
to PG&E's request and make a recommendation to the Cc mission.
The staff review and reco==endation will be contained in a supplement to the Safety Evaluation Report for Diablo Canyon that will be released to the public.

Commission will then hold a public meeting to receive '.he i
staff briefing and recommendation, and may solicit the i
comments of PG&E, the Joint Intervenors, and Governor i

The Commission has not yet determined whether to defer censideration of PGLE's cnticipated request until the Appeal Board decision on design quality assurance is issued.
