Dear Mr. Stello:

This is an appeal pursuant to subsection a(6) of the Freedom of Information Act as amended (5 U.S.C. 522), of the actual denial of the Commission to release documents requested on January 21, 1985 by the Government Accountability Project (GAP) regarding the Comanche Peak Task Force established in March 1984.

By letter dated May 28, 1986, Mr. Donnie Grimsley, Director of the Division of Rules and Records advised us that a review of QA/QC documents covering Appendix T records numbered 1-131 and Appendix U records numbered 1-130 had been completed.

We were informed that of the 131 documents listed in i Appendix T: 1 document was withheld in its entirety pursuant to FOIA Exemption 5 because it contains the advice, opinions and ,

recommendations of the staff concerning potential violations; and I portions of 27 documents were being withheld pursuant to an agreement reached at a May 8, 1985 meeting that identifying information concerning allegers would be protected from dis-closure.

l We were informed that of the 130 documents listed in i Appendix U: 1 document was withheld in its entirety pursuant to FOIA Exemption 5; 1 document was withheld in its entirety i pursuant to FOIA Exemption 4 because it contains commercial  !

information which was provided in confidence to the NRC; and 2 documents were withheld in their entirety pursuant to the agree-ment reached at the May 8,1985 meeting.

Please be advised that the agreement reached at the May 8, 1985 meeting was that the confidentiality of allegers would be protected from disclosure and at no time was it meant to extend to " interviewees" and "other individuals" as ycur letter states.

To the extent the documents withheld pursuant to the May 8, 1985 relate to anyone but "allegers" we appeal their denied release.

Dear Ms. Garde:

This is in further response to your letter dated January 21, 1985, in which you requested, pursuant to the Freedom of Information Act (F0IA), records related to the NRC Comanche Peak Task Force established in March 1984.

We are now placing two boxes of records (boxes 11 and 12) in the OA/0C category in the NRC Public Document Room (PDR) in file F01A-85-59 under your name. In particular, with the exception of three records indicated by asterisks on the enclosed Appendix T, which are undergoing further staff review, we are making i available for public inspection and copying at the PDR the 131 records listed on the enclosed Appendix T and the 130 records listed on the enclosed Appendix U.

The records identified at number 34 on Appendix T and number 42 on Appendix U contain information that is being withheld from public disclosure pursuant to Exemption (5) of the F0IA (5 U.S.C. 552(b)(5)) and 10 CFR 9.5(a)(5) of the Commission's regulations. The withheld portions contain the advice, opinions, and recommendations of the staff concerning potential violations. The record identified at rumber 12 on Appendix U contains information that is being withheld from public disclosure pursuant to Exemption (4) of the FOIA (5 U.S.C. 552(b)(4))

and 10 CFR 9.5(a)(4) of the Commission's regulations because it is commercial information which was provided in confidence to the NRC. The nonexempt portions of these records are being placed in PDR file F01A-85-59 under your name.

Portions of the records identified at numbers 4 through 14,17 through 19, 22 through 24, 26 through 28, 30 through 33, 35, 36, and 127 of Appendix T and numbers 2 and 3 of Appendix U are being deleted without invocation of an FOIA exemption in accordance with the agreement reached between you and the NRC staff at a meeting on May 8, 1985. The information deleted consists of names, personal information, and identifying details concerning allegers, interviewees, and other individuals.

Pursuant to 10 CFR 9.9 of the Commission's regulations, it has been determined that the information withheld pursuant to Exemptions (4) and (5) of the FOIA is exempt from production or disclosure and that its production or disclosure is contrary to the public interest. Any such appeal must be in writing, addressed to the Executive Director for Operations, U.S. Nuclear Regulatory Commission, Washington, DC 20555, and should clearly state on the envelope and in the letter that it is an " Appeal from an Initial F0IA Decision."

A separate set of the released records is being made available for public inspection and copying at the Local Public Document Room (LPDR) located at the University of Texas Library,170 South Cooper Street, Arlington, Texas.

Additional boxes of records subject to your request are currently under review and will be placed in the POR and LPDR in the coming weeks.
