Gentlemen:

Subject: Combined Inspection Nos. 50-220/86-17; 50-410/86-61

This refers to the special team inspection conducted by this office on

August 25-29, 1986 and to the discussions of our findings held by

Mr. Samuel J. Collins with yourself and members of your staff at the conclusion

of the inspection. The inspection was of activities authorized by NRC License

Nos. DPR-63 and CPPR-112 at the Nine Mile Point Units 1 and 2, Oswego, New

York.

The inspection independently examined allegations related to operations,

surveillance, maintenance and quality programs at Nine "ile Point Unit 1 that

were provided to the Niagara Mohawk Power Corporation and the NRC by an instru-

ment and control technician. The inspection assessed the safety significance

and scope of the alleged technical' issues and their broader programmatic

implications for both units. The inspection also incorporated the results of a

Region I investigator's preliminary review of your internal investigation of

the allegations.

Finally, our inspection reviewed the forced shutdown of

Unit 1 on August 22, 1986, due to maintenance performed on the control rod

drive system scram valves, as an independent measure of management's effective-

ness in establishing and resolving the root cause of the problems.

We concluded that many of the circumstances described in the allegations were

substantially true, but the technical significance of these substantiated

allegations were found to be generally minor and no immediate safety concerns

were identified. However, the team did conclude that there were some

programmatic weaknesses in the NMPC management system that must be addressed.

In particular, we concluded that problems identified by your staff are not

always brought to the attention of management for resolution, problem review

for root ~cause determination is in many instances weak, and operational

quality assurance is not as effective as it should be in helping the line

organization find and correct problems.

These issues were identified to you by the NRC during the course of our

'

inspection and at the exit meeting conducted on August 29, 1986.

Attachments 3, 4 and 5 are inspection reports which describe additional

related issues. Additionally, we requested that you conduct your own

investigation of the specific allegations and assess any broader issues they

might indicate. While we believe that the overall management of Unit 1 is

effective and that the weaknesses discussed above do not represent a

fundamental problem that would seriously question the ability of NMPC to

operate Unit 2 safely, we intend to schedule an enforcement conference to

discuss these apparent violations and weaknesses with you including the

results of your internal investigation and subsequent corrective actions. We

will contact you to arrange a mutually agreeable date.
