' *57'*5 HOUSE OF REPRESENTATIVES WASHINGTON, D.C. 20515 February 28, 1986 Honorable Nunzio J. Palladino Chairman United States Nuclear Regulatory Commission 1717 H Street, N.W.
Washington, D.C.

Dear Chairman Palladino:
On February 6, 1986, at meetings in both our offices, Harold Denton, NRC Director of Nuclear Reactor Regulation and Robert Burnero, Director of the Division of Boiling Water Reactor Licensing, o.rovided us with a written schedule for the Commission's response.to'our letter to you dated January 31, 1986, concernina the implications of the January 31 earthquake for the future safe operation of the Perry Nuclear Power Plant.
That schedule promised a response to our letter by February 14.
The Commission's response is now overdue by two weeks.
Several telephone conversations among our staffs have failed to expedite
. i ts arrival.
Accordingly, please have the Commission's response delivered to our of fices by Monday, March 3.
If for some reason
'your response cannot be delivered by March 3, please transmit by that date a written explanation of why this is not possible.
6 As an additional matter, we understand that the ACRS Subcommittee on Extreme External Phenomena will meet on the Perry earthquake
~
matter on March 12, and that the ACRS full committee may take up the matter as soon as the following day.
If it should happen that the ACRS completes its review at the end of those meetings, we would very much appreciate the Commission's allowing us, the public, and the licensee reasonable time to review.the ACRS report prior to issuing a low-power operating license to the plant.
Sincerely,
. w.c d/h-~; t.r{
