Dear Bob:
This is to confinn our telephone conversations of yesterday morning and afternoon, concerning the Commission's plans for allowing the Perry Nuclear Power Plant'to load fuel, and issuing a low-power operating license for the plant to Cleveland Electric Illuminating Company (CEI), the Perry Plant's licensee.
It is my understanding that the Commission intends to adhere to its commit-ment not to allow fuel load or low-power licensing at the Perry facility until:
- 1) the Advisory Comittee on Reactor Safeguards (ACRS) has completed its independent review of the impact of the January 31 earthquake on the Perry Plant; and 2) the ACRS review's conclusions are favorable toward fuel

load and low-power licensing.
(As I'm sure you recall, this commitment was made to Congressman Eckart by Harold Denton, Director of Nuclear Reactor Regulation, at a meeting here in our office which you also attended, on
'g' February 6,1986.)
If my understanding of our conversation is any way incorrect, please let me know, in writing, immediately. Thanks very much for your help.
