Dear Governor Cuomo:

Thank you for your letter of February 10, lo87 expressina your views on the NRC dra#t proposed emergency plannine rule chance and recuesting an opportunity to address the Commission. As you know, the Commission has scheduled a meeting for February ?3, 1987 to be briefed by its General Counsel and Executive Director for Operations on this suh,4ect.

It is not our usual practice to receive comments orior to formal publication of draft rules for oublic comment. However, in this case the Commission has nade an exception, and would be pleased to have you oresent your views on the generic aspects of the proposed change in the emergency planning rule. As you know, the Commission cannot receive comments on the Shoreham plant or other plants which are in the orocess of adjudication before the Commission or its Roards.

The meeting will be held at 1717 P Street, N.W., in the Commissioners' Conference Doom on the lith floor.

The NDC staff is scheduled to brief the Commission at ?:00 p.m.

We have had a number of requests similar to yours from Governors and Members of Concress so it is not possible to establish a specific time for your statement; however, we exoec+ to benin hearino statements from such officials at about 7:30 p.m.

Be advised that the Commission does not intend tc vote at this meetino on whether to publish the draft rule for comment.

Should the Comnission decide to publish the proposed rule chance for comment, it will be at least two months before a final decision can be made on whether to adent the rule.
