Dear Mr. Chairman:
On June 11, 1986, the Commission provided to the Subcommittee three reports regarding the Office of Inspector and Auditor's (OIA) investigations concerning the manner in which NRC's Region V handled issues relating to the licensing of Diablo Canyon.
The Commission requested that the Subcommittee restrict distribution of two of the reports which have not been released to the public.
The first report is an OIA audit report entitled
" Review of Allegations Management for Diablo Canyon," dated March 25, 1986.
The second report is an OIA Report of Investigation entitled "Diablo Canyon - Allegations of Misconduct by NRC Employees," dated October 21, 1985.
I am sure that you will agree that only by keeping the public fully informed on all aspects of the nuclear licensing process can the NRC retain the public's confidence.
The Subcommittee can find no justification for restricting distribution of these documents.
Please provide, by July 10, 1986, legal justification and specific reasons that restricted distribution of these reports and the related correspondence "to the official needs of the Members and staff of the Subcommittee" will serve the public interest.
