PROPOSED FINAL RULES: IMMEDIATE NOTIFICATION (10 CFR 50.72) AND LICENSEE EVENT REPORTING (10 CFR 50.73)

Your memo of December 28, 1982 requested that we review the two proposed final rules and that we respond specifically to two questions: (1) whether the scope and content of these rules would meet our need for operational safety infonnation, and (2) what are our views on the three alternatives that are put forward. We have reviewed the rules.

The Division of Licensing (DL) supports AE0D and the Commission's 1983 Policy and Planning Guidance in going forward with these rules at this time (i.e.

Alternative 3). However, DL believes a strong caveat, extensive editorial re-work, and a slightly delayed effective date are needed. This position is more fully explained by Enclosure #1. ,

The Division of Safety Technology (DST) believes that the effective date of the LER rule should be delayed until it has been shown that the INP0/NPRDS is fully operational and is meeting our data needs. This could be a year or longer. This position is more fully explained by Enclosure #2.

After considering both of these positions, I favor going forward with the rules at this time as suggested by DL.
