Dear Senator Glenn:

This is in response to your letter of February 25, 1986, transmitting a concern expressed by Representative Robert E. Hagan, Ohio House of Representatives, regarding the earthquake that occurred near Perry Nuclear Power Plant on January 31, 1986, and its consideration in the licensing process with regard to emergency planning.

Following the earthquake, a team of NRC inspectors and analysts performed a review of the impact of the earthquake on the Perry plant.

As part of this effort, an evaluation was made of the Perry emergency organization's response to the event.

The Perry emergency plan was activated although there was no regulatory obligation to do so since fuel loading had not occurred and the Perry plant was not licensed to operate at the time of the earthquake.

The inspection team identified three areas of concern related to timeliness of notifications and response, and determined that they were not indicative of any major program-matic failure.

The inspectors observed that the applicant had initiated

corrective actions that will be monitored by the NRC.

The results of the over-all review of the earthquake event are contained in the enclosed supplemental safety evaluation report.

The staff's evaluation was reviewed by the Advisory Committee on Reactor Safeguards who agreed with the staff's conclusion and supported issuance of a license.

A license to load fuel into Perry Unit I and to conduct low power testing up to five percent of full power was issued by the NRC Office of Nuclear Reactor Regulation on March 18, 1986.

A full power license requires the approval of the NRC Commissioners.
