Dear Congressman MacKay:

The letter from your constituents William and Mary Zeller, concerning a possi-ble sale of the Bonneville Power Administration to private interests, has been referred to me for response.

In that letter, the Zellers, who apparently have

invested in, and hold bonds for, the Washington Public Power Supply Sys-tem's (WPPSS) nuclear projects 1, 2 and 3, express a concern over a possible default on such bonds and the loss of any " Federal connection" in financing the WPPSS nuclear projects should the Bonneville Power Administration be sold to private interests.

The Zellers ask that you assure some sort of " Fed-eral backing" for the WPPSS bonds.

As you may know, the Nuclear Regulatory Commission (NRC) licenses and regulates utilities in the nuclear and radiological safety area.

The NRC does not regulate the financial aspects of utility operations and has little or no direct influence over, or involvement in, the financial dealings of utility ap-plicants or licensees.

Thus, we are not in a position to comment on the pos-sibility of any sort of backup for WPPSS bonds for nuclear projects 1, 2 and 3 or to otherwise become involved in the financing of NRC licensed utility activities.

We do have the authority and responsibility to assure that finan-I cial considerations do not cause radiological health and safety problems in l

NRC licensed and regulated activities, and I can assure you that we will car-ry out that responsibility with regard to the WPPSS nuclear projects.

Although I am unable to provide the Federal financial " backup" assurances that Mr. and Mrs. Zeller seek in their letter to you, I do hope that this will otherwise assist you in responding to the Zellers.
