PROPOSED FINAL RULE AMENDING NRC'S GENERAL LICENSE REGULATIONS FOR THE EXP0RT OF TRITIUM (10 CFR PART 110)

Enclosed is a proposed final rule with enclosures covering amendments to NRC's general license regulations pertaining to the export of tritium. Your comments on a previous draft of this rule have been incorporateded in this proposed final package.

j covering)the 110.23(a (3)export into a of dispersed single entrytritium by combiningThis at 5110.23(a)(2). Sections 110.23(a)(2) section and will limit the export of tritium in an dispersed form under the general license to 10 curies per item,1,000 curies per shipment, and 10,000 curies per person per year to any one country. A new 6110.23(a)(3) will pemit the export of large tritium

, light sources under general license when installed in aircraft as safety

devices.

In addition, 6110.2 is being amended to add a definition for tritium. This will further clarify the meaning of tritium to exporters and conform NRC's export regulations with the internationally accepted definition for tritium as set forth in the nuclear suppliers group guidelines. Finally, a minor editorial change in wording is being made in $110.23(c) pertaining to the export of bulk tritium under general license.

Based upon infomation from exporters of dispersed tritium, the impact of this rulemaking action on exporters, even as revised above, will continue to be minimal. Most tritium items contain much less than 10 curies of dispersed tritium. Therefore, these items will continue to be permitted for export under the revised general license. It is estimated that less than 10 exporters will be affected by the rulemaking. However, for those products containing tritium which cannot be exported under the new general license provision, NRC is prepared to consider broad multi-year, specific licenses to cover these exports.
