Pon AC2Sh Aporoved for Publication The Comission delegated to the ED0 (10 CFR 1.40(c) and (d)) the authority to develop and promulgate rules as defined in the APA (5 U.S.C. 551(4)) subject to the limitations in flRC fianual Chapter 0163, Organization and Functions, Office of the Executive Director for Goerations, paragranhs 9213, 038, n39, and 9810.

The enclosed rule will amend Part 110 regulations certaining to the exoort of byproduct naterial by imposing more restrictive unper limits on the exoort of tritium contained in luminescent light sources under the neneral license. This action would preclude the export of large tritium light sources under the general license unless the sources are installed in aircraft as safety devices.

The final rule does not constitute a significant question of oolicy, nor does it amend regulations contained in 10 CFR Parts 7, 8, or 4 Subcart C concerning matters of policy. I therefore find that this rule is within the scooe of my rulemaking authority oursuant to 19 CFR 1.4')(d)(2) and an proceeding to issue it.
