Re: Revised Source Term Proposed Rule Coordination By this e-mail, I am informing my management of the Staffs decision, and request that they make a determination.
Personally, I find this a breach of the agreement which we made with respect to this matter. OGC agreed we would not require inclusion of a specific provision in the proposed rule, out that OGC would discuss the matter in the legal coordination section of the SECY. I interpret this as evidence of NRR's unwillingness to have a.1 admittedly-d fficult issue brought to the Commission's attention, which I do not regard as an acceptable intemal practice.

Geary DRPM management has reviewed the proposed insert (on FSAR updating) you provided for inclusion in the Commission memorandum that forwards the proposed revised source term rule. DRPM management does not believe that the proposed insert is germane to the proposed source term rule and requests it be retracted., DRPM suggests that if OGC believes that there is a deficiency regarding FSAR updating, that OGC should make a recommendation in this regard to NRR management independent of the revised source term rulemaking package.
Please advise me whether or not this position will cause OGC to deny concurrence.
