APPENDIX B NOTICE OF DEVIATION i

GPU Nuclear Corporation Docket No. 50-219 Oyster Creek Nuclear Generating Station clicense No. OPR-16 As a result of the inspection conducted on May 5-9, and in accordance with the NRC Enforcement Policy (10 CFR 2, Appendix C), published in the Federal Register on March 8, 1984 (49 FR 8583), the following deviation was identified:

IE Bulletin 80-11, Masonry Wall Design, dated May 8, 1986, informed licensees that existing test data or conservative assumptions could be used to justify the reevaluation criteria to be applied to existing safety-related walls In letters dated November 14, 1980, the licensee responded to Bulletin 80-11 and and indicated its commitment to complete the actions delineated in the Bulletin.

Contrary to the above, the licensee solely relied upon mortar properties found in the construction specification to determine the strength value for type M r mortar. No documentation was provided which verified that type M mortar was

actually used to construct the walls, no test program was undertaken to l quantify the mortar strengtn, nor were conservative assumptions used for the i reevaluation criteria.

GPU Nuclear Corporation is hereby requested to submit to this of fice within l

twenty days of the date of the letter which transmitted this Notice, a written statement or explanation in reply, including: (1) the correct 4"e steps which have been taken and the results achieved; (2) corrective ste which will be taken to avoid further deviations; and (3) the date when ft conformance will be achieved. Where good cause is shown, consideration wil oe given to extending this response time.
