INTERVIEW REPORT OF h PATRICK CORBETT On December 19, 1996, CORBETT was inferviewed by the reporting agent. The interview was conducted under oath in Conference Room C, Vermont Yankee Nuclear Power Plant (VY), Training Center, Brattleboro, VT. CORBETT was represented during the interview by J. Patrick HICKEY, Esquire, Shaw, Pitman, Potts & Trowbridge, 2300 N Street, N.W., Washington, D.C. 20037 1128.

HICKEY's office telephone number is (202) 663 8103. HICKEY stated that he represented CORBETT ano VY during the interview. CORBETT stated that it was his choice to have HICKEY represent him, and he understood that HICKEY aight share with VY management information discussed during the interview. CORBETT stated that he was not under any pressure trom VY management to have HICKEY represent him. CORBETT provided the following information regarding an allegation that former VY employee James NASSE) was discriminated against because he had raised concerns with a design change for the VY Advanced Off

graduated from the S University of New York at Buffalo in Bachelor of Science in Electrical Engineering. He was hired ) in 1984.

Since the fall of 1995 he has been a Project Engineering Manager. His

. ( supertisor is Edgar LINDAMOND, VY Engineering Director. During the ADGS l A.

  • design change project, he was the Electrical Engineering end Construction l (EE&C) Hanager. He was in that position from January 1994 until the fall of l 1995. Durin supervisor. gHe that time, stated that VYheEngineering Director, h6 kmi MASSEY sinceBernie BllTEAU, 1984, and, was his up until January 1994, when he became MASSEY's supervisor, he was MASSEY's peer and they worked in the same department.

AGENT'S NOTE: According to testimony provided by CORBETT's su arvisor, Bernie Buteau, VY Engineering Director, CORBETT discussed NASSEY during the interview process for the Electrical Engineering and Construction Manager position.

CORBETT stated that he does not recall formally discussing MASSEY with BUTEAU during the interview process for the EE&C Manager position. He does not specifically recall telling BUTEAU that he (CORBETT) believed that MASSEY was not meeti the expectations of, and/or performing to the level of a Senior Engineer, ver, he would not be surprised if he did tell BUTEAU that.

CORBETT stated that he felt that MASSEY had not been held accouptable, and had not been appropriately supervised by his previous managers, comprei to what he believed BUTEAU (who became the Engineering Director in February 1991) expected of his mangers. He said he vas NASSEY's peer for many years and he knew the work expectations and demands that had been placed on him (CORBETT) and MASSEY, and that NASSEY's caabilities and talents were not egual to his, although MASSEY tried his best, (ASSEY did not have the same skills or ability as him.

A MASSEY were placed in his performance appraisals. CORBETT offered his job performance appraisal for the 1994 calendar year (attached), which documents BUTCAU's positive feedback of CORBETT's management of MASSEY (referred to in

-the appraisal as EJH).

-the cc,ntrol and desirn of the system and to make it easier to operate and have i

maintenance performed on it. He said that the design change did not change the actual operation of the system, it only affected the instnneentation and

COR8ETT said that he viewed his disagreement with MASSEY over how the A0GS '

) design change project should proceed, as a differing >rofessional opinion

(DP0), He said that he did not utilize VY's formal De i matter, and noted that MASSEY did not utilize it either, process to resolve CORBETT the stated that  !

proceed in conjunction with the wiring verification. ,

! CORBETT said that he also spoke to VY Contractor Rick ROUTHIER many times and ,

i formally interview' i him on November 19, 1994, regarding the matter. He said

/ that ROUTHIERMelt that the design change could go forward with the process to

(' verify and upgrade the drawings being done together. He said that ROUTHIER told him that the drawings were poor, and that YAEC Engineer Lou CASEY's i _ knowledge of the ADGS controls was poor, but that ROUTHIER felt that the

-drawing problems were resolvable, and that the design cha could be accomplished. He said that ROUTHIER told his that he had n effectively utilized by MASSEY on the project, but ROUTNIER's statement on that was not

"that strong," He said that ROUTHIER told him that VY had applied adequate resources to the project, but that YAEC had not ag)1ied adequate resources.

l He added that ROUTHIER told him that YAEC left CAL EY ' hanging" on the project.

CORBETT agreed that there were problems with the A0GS drawings, and because of L that, he gave MASSEY more resources (ROUTHIER'and another electrician) and took MASSEY off of all his other work as stated in the April 11, 1994, l memorandia (attached), so he could solely work on the design change. CORBETT i said that he a l discrepancies,pplied to move more the designand forward, more resources and to try to resolve and compromisethe drawing with MASSEY. CORBETT said that the more data that came-in, the more it did not sup) ort NASSEY's claims, in that the drawings were not that bad, and the pro)1em was not as large as MASSEY believed it to be.

CCRBETT that the failure to have the design ready for the outage was not all Y's fault,' but as a Senior Engineer, it was expected that MASSEY would pursue the resolution of the discre>ancies and problems with CASEY and

, YAEC because every design change project tas those type of problems. He feels

that MASSEY performed poorly on the A0GS project, and in general, the managing of problems and moving forward, He said that MASSEY would raise a drawing C- discrepancy and then expect someone else to resolve it, cosamenting that if MASSEY had put as much energy into the resolution of the problems, as he did in raising them, then he would have solved them.

CORBETT stated that, from his perspective, HASSEY's ' safety issues" with thn A0GS' design change were: would the plant be able to predictably put the A0GS back intorecalls specifically service during asting MASSEYthewhat outage witr'mitmeant Nt (MASSEY having)to extend the outage? He by " safety concerns " and MASSEY told him what he doceented in his February 7,1995 E Mail to BUTEAU (attached), which reads, "EJM responded by mentioning that it was the many wiring errors that made it such that it couldn't be done. After furtherdiscussionheindicatedthatitwasjobsafety,confidenceonthe 1

outcome, asked what he when did inyou pushtothe ressonse button that HASSEY p:u get statement theJune in the desired results " When 22, 1994, memorandum (attached), tut, "I have expressed, and I want to make it

! perfectly clear, that with this many wiring / design errors in ADG, Vermont l Yankee is taken (sic) an unnecessary risk to safe plant operation, and this design shouldn't be done until all the wiring / design errors have been identified and corrected," he stated that he could not specifically recall doing anything, as it was more of the same concerns from MASSEY regarding the design change, .

CORBETT stated that in November 1994 the outage management team was getting concerned because the A0GS design was not ready or completed, and because of that, the plug started to be pulled on the project being included in the

-C. outage schedule. He called November 1994, the " final hour" on whether the design package would be ready for the outage, CORBETT stated that he gave MASSEY the November 15, 1994, disciplinary letter (attached), primarily as a result of NASSEY's wr perfonnance on the A0GS cesign change project. Ho specifically cited fiASSEY's failure to prepare periodic reports, including those related to the project, in conformance with VY procedures and requirements.

. (attached) as a result of NASSEY's fa.11ure to have the A0GS design properly com>1eted for.its presentation to the Plant Operations Review Committee (PORC) on lovember 2, 1994. CORBETT stated that he never had a " bigger disconnect

  • between what was expected of a document to be presented to PORC, and what MASSEY produced just prior to the presentation. CORBETT stated that he felt MASSEY should have been teminated at that point because he had tried.

When asked why he had not taken MASSEY off of the project earlier. CORi>ETT stated that he had discussed that possibility with BUTEAU, COR3ETT stated Cf that he had a large amount of work in his de>artment that needed to be completed, and he did not readily have the a)111ty to take a >oor performer off of an assignment and assign someone else to it. He also ind the concern of reassigning MASSEY from the ADGS design change project to a more safety

-significant project.

Regarding MASSEY losing his office, COR8ETT stated that in late 1995 or early

-1996, in conjunction with the VY Engineering Department reorganization, the Engineering building was refurbished, employees were displaced, and MASSEY ended up without an office. CORBETT stated that he concluded that MASSEY was not going to be a > art of the new Engineering organization, because VY management was looting for a different position for MASSEY. He said there were discussions to find MASSEY a position in the Maintenance Department, and an agreement was reached that he would go there. As a result of that and in conjunction with the building renovation, MASSEY lost his work space w,ith the understanding that MASSEY was leaving the Engineering organization. CORBETT said that usSEY's ' stuff" was moved out to the craft lunch area of a modular

' office building where contractors were located, although MASSEY was the only VY employee in that m>dular building. CORBETT agrees that there was miscommunication in how that was done and that it was wrong, but that MASSEY's

He added that VY Vice President Jay THAYER war involved in those discussions. He stated that he told THAYER, during the interview process for his current position, that he had dealt with MASSEY for two years, and that he had done everything he could, including being unsuccessful in attempting to have MASSEY terminated and because of those issues, he should not be MASSEY's supervisor anymore,. He said that when he accepted his current position.- he anderstood that MASSEY would not be assigned to work in his organization, but that MASSEY would be working in the Maintenance Department.

CORBETT stated that he rated a job performance appraisal for MASSEY covering the 1995 cal r year, but it was never issued. He said that during the evaluation period he experienced MASSEY not being successful on other projects that he was assigned during that period. He said that the evaluation was not issued because: 1) of his belief that MASSEY was going to work in the Maintenance Department: 2) MASSEY was out on a lot of sick leave in 1995: and

3) his conversations with THAYER identified that there was no benefit to issuing the appraisal. - - .

opinion, that because NASSEY lost his supervisory role, MASSEY r.ever really supported the reorganization because he thought thn VY was going in the wrong direction. He Jaid that NASSEY did not fit in well in the new organization C because of his lack of capability.
