OFFICE OF NUCLEAR MATERIAL SAFETY AND SAFEGUARDS Items of Interest Week Ending June 17, 1988 LOW-LEVEL WASTE MANAGEMENJ Low-level Waste NRC-DOE Meeting on Disposal of Hanford Defense Wastes On June 9, 1988, NRC staff met with DOE staff (Defense Programs) to discuss disposal plans for Hanford tank wastes..The NRC staff has been particularly concerned about DOE's waste classification system for the radioactive waste in the Hanford tanks (SECY-88-144). DOE identified six different waste streams that it intends to process for disposal at Hanford. These include (1) phosphate / sulfate waste, (2) plutonium finishing plant waste, (3) cladding removal waste, (4) neutralized current acid waste, (5) double-shell slurry feed, and (6) double shell slurry.

DOE indicated that it intends to initiate the processing of the phosphate / sulfate wastes (PSW) in July 1988 by grouting and disposing of the grout in a shallow land burial facility at Hanford. The PSW wastes are a result of primary loop decontamination of N-reactor and ion exchange wastes.

These wastes are clearly low-level wastes and have been segregated from the other Hanford wastes. NRC staff indicated that it sees no reason why DOE could not proceed to dispose of these wastes as low-level wastes.

I DOE intends to treat the neutralized current acid waste (NCAW) as HLW. These wastes will bc vitrified into borosilicate glass logs for eventual disposal in a geologic repository.

l 00E indicated that it intends to treat the remaining wastes as low-level waste and dispose of them via the grout facility.

It was concluded that more discussions between NRC and DOE are needed to clarify the classification of the wastes in these four categories.

HIGH-LEVEL WASTE MANAGEMENT High-level Waste Study Plan DOE has submitted to NRC two study plans for DOE's Yucca Mountain, Nevada site characterization program. The study plans, "Study Plan for Water Movement Test" and "Excavation Investigations," cescribe testing to be performed in the shaft during the construction phase of the Exnloratory Shaft Facility (ESF).

2 The HLWM staff has started its review of these study plans in accordance with the "Draft Review Plan for NRC Staff Review of DOE Study Plans and Procedures."

The initial review, or Acceptance Review, is to detemine whether the plan contains information DOE and NRC previously agreed would be included.

If the study plan is accepted for further review, the next review stage is a Start Work Review to determine if there are objections NRC would have to DOE's starting the study. NRC has agreed to provide such objections to DOE within three months of receipt of the study plan. During the Start Work Review, the NRC staff will make a decision on whether a Detailed Technical Review needs to be conducted.

INDUSTRIAL AND MEDICAL NUCLEAR SAFETY Materials Safety Update on Cesium Release at Radiation Sterilizer Inc.'s (RSI's)

Decatur, Georgia facility (ref.: FNO-II-88-40 ff)

DOE informed the licensee by letter dated June 13, 1988, that its Oak Ridge Operations Office has agreed to provide assistance in the form of managing the effort to identify and remove the source of the cesium leak at the RSI Decatur, Georgia facility, and to clean up the facility.

The Governor of the State of Georgia announced in a news release on June 13, 1988, that the source removal and recovery activities will be coordinated by DOE, the State of Georgia and other agencies.

NMSS is preparing a letter to 00E requesting information which will assist NRC in determining what further steps, if any, need to be taken at other licensed facilities, both in the short term and long term, to assure safety.

SAFEGUARDS Domestic i

DOE Test of Satellite Communications / Tracking Systems DOE will undertake final technical evaluation of two commercial, mobile satellite systems, Omininet and Geostar within the next few days. DOE plans to install one such system (approximately 40 receiver / locater sets) in vehicles used primarily for shipment of defense wastes to the Waste Isolation Pilot Plant, Carlsbad, NM, and for other hazardous and "highly visible" DOE cargoes. Test results are of interest to SGTR licensing staff. Cost and performance advantages may be of interest to NRC licensees.

Transportation Meeting Regarding NUREG-0170 Update Transportation Branch personnel travelled to San Antonio, TX and Albuquerque, NM to meet with staff from the Center for Nuclear Waste Regulatory Analyses (CNWRA) and Sandia National Laboratories (SNL) regarding the development of the NUREG-0170 update. NUREG-0170 is the Final Environmental Statement on the Transportation of Radioactive Material by Air and Other Modes, and has not been updated since its completion in 1977. Meetings were held to discuss the project direction with CNWRA, the performing organizaticn, and to assist in technology transfer from SNL staff who developed NUREG-0170 and who currently maintain transportation risk analysis corguter codes. The draft update is scheduled to be submitted in FY 1990.

OFFICE OF NUCLEAR REGULATORY RESEARCH Items of Interest Week Ending June 17, 1988 PRIMARY SYSTEM INTEGRITY Training of NRC Region I Staff for Detection of Intergranular Stress Corrosion Cracking Three NRC NDE staff from Region I (Harry Kerch, Richard Hart is, and Mike Oliveri) spent the week of June 6, 1988 working)with NRC NDi Research Contractor at Pacific Northwest Laboratory (PNL participating in hands-on training using field inspection equipment. The training initially focused on flat plates that contained a variety of machined reflectors (i.e., sawcuts) of various depths, machined reflectors that were at various angles to simulate cracking along the heat-affected zone of a weld, and a series with back-surface angulation to reflect the effects of counterbores. Next, the RI staff examined and learned the ultrasonic scattering properties of a series of mechanical fatigue cracks, thermal fatigue cracks, and laboratory-grown intergranular stress corrosion cracks. Blind tests were administered to assess the starting point of knowledge that the RI staff members had. During the four days, there were other blind tests given to assess the increase ir, knowledge and to provide feedback to the staff on the areas where further work was needed. Two days were spent in inspecting some of the decontaminated recirculation system weldments that had been removed from the Monticello and Verunt Yankee nuclear power plants in both training and blind testing.

This hands-on experience will assist the Region I staff in passing the IGSCC perfonnance demonstration test at the EPRI NDE Center.

IEB 83-02 requires that all field inspectors who con-duct ultrasonic examination of BWR piping for detection of intergranular stres!,

corrosion cracking be qualified. An NRC/EPRI/BWROG Memorandum of Understanding accepts the EPRI NDE Center program for training, testing, and qualification of NDE personnel for IGSCC detection for meeting the requirements of IEB 83-02.

RI is an NRC-wide resource for conductir.g independent NDE examinations. They have personnel and equipment for this purpose.

RI personnel are called upon to conduct third party ISIS at any plant (in all regions) as needed.

If the third party inspection results of RI personnel are to be credible and accept-able in any dispute regarding the presence or absence of IGSCC, RI personnel must also be qualified.

In addition, the RI personnel had an extensive review and demonstration of the synthetic aperture focusing technique (SAFT) field system recently assembled and validated under NRC research contract and learned the features and ease of use of the system. The SAFT system is a very versatile system that can be used as an independent tool by the NRC to inspec; areas of interest.

This report describes the themal overload protecti';e devices for safety-related motor-operated valve operators along with current and previous NRC guidance for the use of overload protection.

It is reconvrended that unifonn acceptable practices for the overload protection of valve motor operators be developed in the fonn of a standard or guidance document for the industry by cognizant standards developing organizations.

Items of IntGrest Office for Analysis and Evaluation of Operational Data Week Ending June 17, 1877 Diagnostic Evaluation and In:ident Investigetion The NRC evaluation report of the ENERCON Independent Management Appraisal of Turkey Point and Florida Power and Light (FP&L) received AEOD senior management review. The report is being finalized and by June 22, 1988 is expected to be sent to the Region II Administrator for transmittal to FP&L.

Incident Response On June 13 and 16. IRB staff members made technical presentations es part of the Planning for Nuclear Emergencies Course at the Harvard School of Public Health. The presentations involved the evaluation of dose models for airborne releases and training progra.s for accident / incident response.

Or, June 14, the Chief, IRB and staff met with representatives of the Israeli National Information Center for Toxic and Hazardous Materials to discuss the NRC's role and procedures during nuclear reactor and other radiological events regarding the transmittal of infonnation to and interactions with other government agencies, the public, and the press.

On June 16, the Director. AEOD and Chief, IRB conducted a tour and briefing of the Incident Response Center for Dr. Hans Blix, the Director General of the International Atomic Energy Agency.

Technical Training The Babcock and Wilcox (B&W) simulator has been installed and Power Safety International (PSI) has completed all initial wiring and diagnostics. TTC, General Electric, and PSI personnel are currently conducting the simulator acceptance test to evaluate the upgrade provided as part of the contract.

The test is going very well and is scheduled to be completed by close of business, June 17, 1088. The first NP.C course on the B&W simulator is scheduled for July 11,1988.

Safety _ Programs A meeting of the Interoffice Task Group on Performance Indicators was held on June 16 in support of maintenance P! development. The meeting had participation from Regions I, II and 111, RES and NRR.

The objectives of identifying candidate maintenance Pls and candidate plants from which data are to be collected were met. Minutes of the meeting, including followup actions and schedules are being prepared.

The Director, Division of Safety Programs, met with the CE Owners Grcup on i

June 15 to discuss AE00 studies. The meeting was set up to allow for an exchange of information regarding how AEOD uses LER infor,;.ation in its trends and patterns orograms.

Interest was s; icon by the Owners aroup with regard to the trip reduction study and review, and the service water case study.

STATE, LOCAL AND INDIAN TRIBE PROGRAMS State Liaison Officer (SLO) Meeting in Region V On June 14-15, 1955, State, local and Indian Tribe Programs (SLITP) hosted a meeting for the Governor-appointed SLO's in Region V at Walnut Creek, California. Discussions focused on low-level radioactive waste issues, radicgraphy enforcement actions, Congressional initiatives, and the proposed Commission Policy Statement on Cooperation with States at Comercial Nuclear Power Plants and Other Nuclear Production or Utilization Facilities. Emergency response and high-level radioactive waste issues were also discussed.

Representatives from the National Conference of State Legislatures and the Western Interstate Energy Board made presentations along with NRC staff from Region V, NMSS, NRR, and SLITP.

Meeting of the National Congress of knerican Indians' (NCAI) National Indian Nuclear Waste Policy Committee (NINWPC)

Rosetta Virgilio, SLITP, made a presentation June 15, 1988, in Green Bay, Wisconsin, before NCAI's NIN'!PC. The meeting centered on NRC':. contract with Indiana University to update NUREG/CR-1620 Survey of Current State Radiological Emergency Response Capabilities for Transportation Felated Incidents. The current update will include a select number of Indian Tribes (15) whose reservation boundaries are crossed by spent fuel shipment routes designated in NUREG-0725, Revision 5. Public Information Circular Showing State-by-State Spent Fuel Shipment Routes.

Eric Mitter, Indiana University, assisted in presenting a more detailed description of the administration of the survey. Tribal representation included the following: Western Shoshone; Menominee; Umatilla; Oneida; and Seneca.

Federal representatives included DOE, EPA, and FEMA. Copies of the following documents were provided to the NINWPC:

Sheffield Settlement Agreement The State of Illinois and US Ecology. Inc. have agreed to a plan for the closure, care, and mainte ance of the low-level radioactive waste site near Sheffield, Illinois. The plan requires remedial action and cash payments by the company over the next 10 years, at which time responsibility for the site l

will revert to Illinois. The settlement agreement was forwarded to the Illinois Circuit Court which was expected to use it as a basis for dismissal of a State-initiated law suit against US Ecology.

IDNS advised SLITP that formal notification of the settlement agreement is forthcoming.

NRC is proud to have two of its nominees selected for this prastigious program. After a three-week orientation program, beginning in November 1988, program participants are assigned full-time work assignments in the House of Representatives and the Senate.

A Notice of Violation and Proposed Imposition of Civil Penalty in the amount of $150,000 was issued on June 10, 1988 to Southern California Edison Company (San Onofre Unit 1). The action was bast ' on violations of equipment qualifi-cation requirements of 10 CFR 50.49.

A Notice of Violation and ProposGd Imposition of Civil Penalty in the amount of $50,000 was issued on June 13, 1988 to Virginia Electric and Power Company (Surry Nuclear Station, Units 1 and 2). The action was based on failure to verify operability of required boric acid piping heat tracing circuits on a monthly basis as required by the plant technical specifications.

A Notice of Violation and Proposed Imposition of Civil Penalty in the amount of $100,000 was issued June 13, 1988 to Virginia Electric and Power Company (Surry Facility). The action was based on a number of violations including:

(1) failure to adequately evaluate the radiation hazards present during work on an incore detector, (2) inadequate procedures for freeing)the incore detector and for briefing those involved in the work, and (3 failure to conduct operations in accordance with approved procedures.

The base civil penalty was increased by 100%.

A Notice of Violation and Proposed Imposition of Civil Penalty in the amount of $12,500 was issued June 13, 1988 to UNC Naval Products, Inc., Uncasville, j

Connecticut. The action was based on several violations including:

(1) failure,

on a number of occasions, to adequately measure airborne activity and adequately survey the radiological conditions; (2) failure to adequately control the amount and direction of ventilation flow; (3) a lack of adequate procedures for implementing the radiation safety program; and (4) failure to perfonn adequate audits cf the radiation safety program.

An Order Imposing a Civil Penalty in the amount of $625 was issued on June 13, 1988 to Joslin Diabetes Center Inc., Boston, Massachusetts. The action was based on several violations including a cumulative exposure to the right hand of a research investigator. The licensee responded to the Notice in a letter dated April 28, 1988 atJ requested mitigation of the $2,500 penalty. After consideration of the licensee's response, the penalty was mitigated by 75%.

A Notice of Violation and Proposed Imposition of Civil Penalty in the amount of $50,000 was issued on June 15, 1988 to Carolina Power and Light Company.

The action was based on the failure of the 10 CFR Part 50 Appendix K required ECCS evaluation tredel used to reflect the most damaging single failure relative JUNE

to the ECCS safety injection subsystem. The evaluation results erroneously assumed that two of the three SI pumps would be operable during design basis accidents. There were several scenarios where only one SI pump would be operable and not meet the single failure criteria.

An Order Imposing a Civil Penalty in the amount of $2,500 was issued to Gamma Diagnostic Laboratories, Attleboro Falls, Massachusetts. The action was based on a cumulative radiation exposure in excess of the regulatory limit to the left hand of a laboratory supervisor. After reviewing the licensee's response, the civil penalty was reduced by 50% because of the licensee't inability to pay.

An Order Suspending License (Effective Immediately) and Notice of Denial of Application for Renewal of License was issued on June 15, 1988 to Maurice P.

Acosta, Jr., a licensed reactor operator at San Onofre Station. The action was based on the licensee's failure of three drug tests conducted by the Southern California Edison Company (SCE) in accordance with SCE's fitness for duty program.

A Notice of Violation and Proposed Imposition of Civil Penalty in the amount of $450,000 was issued on June 16, 1988 to Carolina Power and Light Company (H. B. Robinson Unit 2). The action was based on violations of the equipment qualification requirements of 10 CFR 50.49. The staff had submitted the action for the Comission's review and via memorandum dated June 16, 1988 was infonted the Comission had no objection to the issuance of the civil penalty. (EN 88-56)

A Notice of Violation and Proposed Imposition of Civil Penalty in the amount of $200,000 was issued on June 16, 1988 to Detroit Edison Company (Fermi Unit 2).

The action was based on two problems (1) the licensee's containment isolation provisions for the primary containment radiation monitoring system was not consistent with the requirements of 10 CFR Part 50, Appendix A, General Design Criterion 56, and (2) the licensee operated the Noninterruptable Air System in a degraded mode which led to the violation of Two Technical Specifications.

The penalty was escalated by 50% for each of the violations. (EN 88-52)

Civil Penalty Paid Joslin Diabetes Center, Inc., Boston, Massachusetts Wid the imposed civil penalty in the amount of $625. The action was based on a cumulative radiation exposure to the right hand of a research investigator. The civil penalty was mitigated by 75% after considering the licensee response.

Civil Penalty Paid Omaha Public Power District (Ft Calhour. Station) paid the proposed civil penalty in the amount of $112,500. The action was based on a number of procedural violations in the area of radiation protection including the failure to control a very high radiation area which is a repeat violation. The penalty emphasized the need to improve radiation protection control in light of the licensee's past enforcement history.

On June 14, 1988 the Regional Administrator accompanied the Resident Inspectors and other selected members of the Regional staff on a tobi of the Georgia Power Company's Forest Park, Georgia, repair facility for environmentally qualified equipment.

On June 14, 1988 representatives of the Carolina Power and Light Company were in the Region II Office to attend a meeting regarding followup to the January 1988 AIT and other valve failures.

An enforcement conference with the Waterford 3 licensee is scheduled in the NRC Region It office on July 14, 1988 at 1:00 p.m., CDT. The circumstances during the last refueling outage which led to a loss of reactor vessel level control and a possible loss of shutdown cooling are to be discussed.

Region IV is supplying two days of one-on-one (July 14-15) training in licensing and inspection procedures for a new radiation physicist in the Idaho Radiation Control Program. The training will cover the most common types of licensees found in the State of Idaho.

Idaho has experienced a period of over six months in attempting to fill two key vacancies in the materials program, one of which remains unfilled at the present time.

Stone and Webster management representatives will be in the Region IV office on June 15, 1988, to present the results of their management assessment of Fort Calhoun Station and the corporato nuclear support organizations of the Omaha Public Power District (OPPD). Commissioner Car" emphasized to DOE that in times of limited resources, DOE siould continue prioritizing efforts in order for the NRC staff to focus its limited resources on the most important activities.

Commissioner Carr also encouraged DOE to pursue the most cost effective remedial actions consistent with potential risk to the public health and safety.
