I am responding to your letter of lVlay 30, 1997, forwarding a question from a constituent, Mr. Jim Ryan, on possible shipments of nuclear fuel rods from Miami to Utah.

Mr. Ryan questioned why such shipments should not be transported by ship from Florida to Texas and then via truck to Utah.

The Nuclear Regulatory Commission is not aware of any potential shipments of irradiated reactor fuel from the Miami area to Utah, The nearest nuclear power plant to Miami is the Turkey Point facility in Homestead, Florida, which NRC has licensed to the Florida Power and Light Corporation (FP&L). Our records indicate that two small irradiated reactor fuel shipments were made in 1978 and 1979 from Turkey Point to a Department of Energy contractor in Ohio.

Presently, FP&L has no plans to ship irradiated reactor fuel from Turkey Point to any offsite facility.

NRC does not have the responsibility for regulating the safety of routes used to ship irradiated reactor fuel. That authority is vested in the Department of Transportation (DOT).

Licensees may choose the mode of shipment (e.g., rail, highway, or ship) and the route, provided they comply with the DOT's regulations on hazardous materials, routing, and modal restrictions contained in Title 49 of the Code of Federal Regulations.

NRC does have responsibility for regulating safeguards (physical security) requirements for the shipment of commercial irradiated reactor fuel.

I have enclosed a copy of NUREG-0725; Rev.11, "Public Information Circular for Shipment of Irradiated Reactor Fuel," July 1996, describing NRC's safeguards responsibilities.

In your letter of October 13,

1992, you urged the U.S. Nuclear Regulatory Commission (NRC) to work with the Federal Emergency Hanagement Agency (FEHA) and Florida officials'o complete a reappraisal of offsite emergency preparedness for the Turkey Point Station as quickly as possible.

When we received your letter, we were working closely with FEHA and the Florida Power and Light Company to ensure that the offsite emergency planning and preparedness continue to be adequate following Hurricane Andrew.

As you know, the NRC relies upon FEHA's findings and determinations in judging whether local emergency plans are adequate and can be implemented.

On October 23, 1992, Hr. Grant Peterson, Associate Director of FEHA, informed

'e by letter that, on the basis of its assessment and compensatory measures

taken, FEHA "can reaffirm that there 'is reasonable assurance that the public health and safety can be protected in the event of a radiological emergency at the Turkey Point Nuclear Power Plant.

FEHA will continue to monitor the implementation of the few remaining areas where action is in progress" (Enclosure 1).

Accordingly, the conditions which.led to my request that Turkey Point not be operated until FEHA had the opportunity to review offsite emergency preparedness have now been satisfied, and there is no longer any reason from the standpoint of nuclear safety that the plant cannot resume operation.

I promptly informed the licensee of this by telephone and letter on October 23, 1992 (Enclosure 2).

Turkey Point Unit 4 was restarted soon thereafter.
