Installation.

Dear Sir:

This application for amendment proposes changes to Tables 3.1-1 and 3.2-1 of the James A.

FitzPatrick Technical Specifications.

Table 3.1-1 will be changed by deleting the requirement for a reactor scram on main steam isolation valve (MSIV) closure in the refuel and startup modes.

Note 3 to the Table will be deleted.

This note established 1005 psig as the reactor pressure below which the scram is bypassed.

In Table 3.2-1, reference to Note 7 will be added for MSIV closure on low condenser vacuum (LCV).

This will retain main steam line (MSL) isolation in the run mode.

Note 8, which states that MSIV isolation is bypassed below 1005 psig on LCV with the turbine stop valves (TSVs) closed, will be changed.

The revised note will read, "Bypassed when mode switch is not in rur, mode and turbine stop valves are closed."

The proposed change is the result of a plant modification to remove four pressure switches 02-3PS-51 (A-D).

These suitches establish the pressure setpoint below which a bypass function is activated in the scram and isolation logics.

The pressure switches were installed after instability was observed in an early European Boiling Water Reactor during its startup.

Subsequent startup tests at Browns Ferry, a BWR 4 reactor as is FitzPatrick, showed that the instability observed in the European reactor did not exist in a BWR 4.

pressure switches are not necessary.

Furthermore, for FitzPatrick, the setpoint for these switches is currently 1005 psig which is the normal reactor pressure at full power.

Since the reactor is well below 1005 psig in the refuel and startup modes, reactor scram on MSIV closure and MSIV closure on LCV are always bypassed in these modes.

Therefore, the pressure switches will be removed and the scram and isolation functions deleted for the refuel and startup modes.

The Authority plans to complete this modificition during the current refueling outage.

The startup is scheduled for November 7,

1988.

The Authority requests that the NRC notify if approval of the changes to the Technical Specifications can be granted to meet this schedule.

Enclosed for filing is the signed original of a document entitled "Application for Amendment to Operating License," with Attachments I and II thereto, comprising a statement of the proposed changes to the Technical Specifict.tions and the associated Safety Evaluation.

In accordance with 10 CFR 170.12, a check in the amount of

$150.00 is enclosed as payment of the application fee for the review of the proposed changes to the Technical Specifications.

In accordance with 10 CFR 50.91, a copy of this application and the associated attachments are being provided to the designated New York State official.

These proposed changes to the Technical Specifications supercede the changes submitted in Reference 1 pertaining to the pressure switches 02-3PS-51 (A-D).

Therefore, the request for license amendment in Reference 1 for those changes is hereby withdrawn.
