ATTACHMENT TO LER Mo. 78 - 115/ 99 L-O COMMONWEALTH EDISON COMPANY ZIOM GEMERATING STATION 50-295 Description of Event During the period 3/14/78 to 7/26/78, twelve single package shipments of greater than Type A quantities of radioactive material -

L.S.A. (Transport Group III) were made without prior written notification to MRC for the first time use of each package. This is a violation of 10 CPR 71.12 (b) (1) (iii) .

In addition, four of these shipnents each involving the Hittman Nuclear Developnent Corporation UN 600 cask were made! ,

a. without having (at the time of shipment) a copy of the package's certificate of conpliance and appropriate referenced documents, and

b. in secondary containers which did not meet the requirenents for Type A packagino as required by the HM600 certificate of compliance.

These are violations of 10 CFR 71.12 (b) (1) (i) and (ii) respectively.

Consequences of Occurrence 10 CFR 71.12 (b) (1) (iii) is a notification requirement only and does not require a response from the tiRC permitting use of the package.

The failure to satisfy this requirement does not involve any safety itens since the packages have already been approved by the MRC for use. ,

The four UN600 shipments contained quantities of radioactivity ,

ranging from 4.5 curies to a naximum of 9.25 curies. Considering the small quantity of radioactivity in each of these shipments, no safety implications were involved and the health and safety of the public was not affected.

Cause of Occurrence The notification requirenant of 10 CPR 71.12 (b) (1) (iii) was initially interpreted as not applicable to the Station since Hittnan Nuclear, Inc. was already registered with MRC as a user of the package.

The Station had requested from Hittman Nuclear, a copy of their HM600 certificate of compliance and appropriate referenced documents prior to using the cash. In the interim the Station accepted a verbal communication from Hittman Nuclear regarding the. limitations of the certificate of compliance. At this time Hittman Nuclear failed to inform the Station regarding any secondary container requirements.

In addition the secondary containers were provided by Hittman and filled with concentrates (and solidified in cement) under the guidance of Hittman supervisory personnel on site.

Corrective Action The Station, upon receipt of the HM600 certificate of compliance, recognized the oversight and took immediate action to suspend HN600 shipments until Hittman Nuclear licer sed the cask for greater than Type A quantities and completed the required nodifications.

As of July 27, 1978 the Station registered with the MRC to use the Hittman packages. The Station is now in full compliance with 10 CFR71 and no further action is necessary.
