SUBJECT: NOTICE OF VIOLATION

(NRC INSPECTION REPORT NOS. 50-413/88-06 AND 50-414/88-06)

This refers to the Nuclear Regulatory Commission (NRC) inspection conducted by

P. K. Van Doorn on January 11-15, 1938. The inspection included a review of

activities authorized for your Catawba facility. At the conclusion of the

inspection, the findings were discussed with those members of your staff

identified in the inspection report. The report documenting this inspection

was sent to you on January 27, 1988. ,g

NRC concerns relative to the inspection findings were also discues'ed in an

Enforcement Conference held on February 23, 1988. A summary of this Enforce-

ment Conference is enclosed.

Areas examined during the inspection are identified in the report. Within

these areas, the inspection consisted of selective examinations of procedures

and representative records, interviews with personnel, and observation of

activities in progress.

The inspection findings indicate that certain activities appeared to violate

NRC requirements. The violation, references to pertinent requirements, and

elements to be included in your response are described in the enclosed Notice

of Violation. Although you identified the violation and took appropriate

corrective action, this violation is being issued because of the length of

time it took you to recognize the problem. We feel that if'the potential

unanalyzed condition in the Nuclear Service Water system had rece;ved closer

scrutiny for determination of reportability in a more timely manner, then the

vit.lation would have been identified earlier. Also, the potential for placing

the olant in the same or similar conditions again would have been minimized.

In acdition to the specific matters identified in the violation, we are also

conceaned about the area of reportability. Although we have found your actions

with regard to this particular issue did not violate NRC regulations, it was

not s. clear-cut situation, and enhanced communications with the NRC on marginal

issues would improve your credibility regarding matters of reportability.

We acknowledge your practice of keeping the NRC informally informed

and encourage continued pursuit of this practice. However, we feel in

cases of this magnitude and complexity more formal communication would

be mutually beieficial. We understand from the Enforcement Conference

that you plan to increase your sensitivity towards reporting and your

attention to thorough and prompt review of problem reports. In your

response to the violation, we request that you address your plans for

improvement in these areas.

In accordance with Section 2.790 of the NRC's "Rules of Practice,"

Part 2, Title 10, Code of Federal Regulations, a copy of this letter

and its enclosures will be placed in the NRC Public Document Room.

The responses directed by this letter and its enclosures are not i

subject to the clearance procedures of the Office of Management and l

Budget as required by the Paperwork Reduction Act of 1990, - Pub. L. i
