MEMOR ANDUM AND ORDER A
The Appeal Board demes a motion by apphcant for directed certifwaten of a Licenung Board ruimg that allowed intervenors to amend - after obsamms discovery from the NRC staff
- a comention that the Board previously found to tie msufGciently speciGc.

in deculms whether to cuercese its dncretionary directed certifwation authoney, appeal f boards apply a two-part test. It considers whether a licenseg board ruimg enher (1) threatens i
the party adverwly affected by it wah immediate and sermus arreparable impact which, as a '
practical matter, could not be alleviated by a later appeal, or (2) afYects the basic structure of the proceeding m a pervasive or unusual manner. Pubhc Service Co. of Indiana (Marbie tidl Nuclear Generstmg Siaten, Umts I and 2), ALAB.405,5 NRC 1890,1892 (1977), see, e g, Metropoli-tan Edison Co (Three Mde Island Nuclear Staten Umt il, ALAB-791,20 NRC 1579,1582 (1984).
C Smce the admrssson of one or more additenal mues mio an ongomg case seldom has a pervauve or unusual effect en the basse structure of a proceedms, appeal boards have tradnional-ly dechned to revice on an interlocutory haus ruimet that simply admn another comenten. See, e s, Cleveland Electnc illummatmg Co (Perry Nuclear Power Plant, Unns I and 26, ALAB 706,16 NRC 1754 (1982).
D The base structure of an ongoms adjudication is not changed simply becauw the admis-sion of a contemion results from a hcensms board ruimg that is important or novel, Metropolatan ;
Edison Co (Three Male Island Nuclear Station, Umt I), ALAB 791, 20 NRC 1579,1583 '

Similarly, the mere fact that a party must htisaie an adddsonal issue, or that a matter mit be subject to adversanal esploranon rather than NRC staff review, does not aher the base structure of the proceeding in a pervasive or unusual way no as to justify enterlocutory review of a hcensms board decinon. See Aruona Puble Service Co.

E Although the general standard for mierlocutory revsew is the same whether or not under-taken on certifaation or by referral, see Virginia Electrw and Power Co. (Nonh Anna Power Sta-taon, Unns I.ind 2), ALAB-741,18 NRC 371,375 n 6 (1983), an appeal board is more hkely to antercede where a hcenang board Feheves that its ruhng has the type of overall impact on the proceeding that warrams the appeal board's immediate attention.
