NOTICE OF ENFORCEMENT DISCRETION - NEW STANDARD TS SURVEILLANCE REQUIREMENT CHANGE OVERSIGHT Discussion:

On January'll,1997, Southern California Edison (SCE), the licensee for  !

SONGS Unit 3, informed the Senior Resident Inspector that the I surveillance tests of record for two refueling interval TS surveillance requirements, last performed in 1995, for both EDGs in Unit 3, did not satisfy surveillance requirements in the new standard TS implemented in August 1996 (Amendment 127). The tests involved were the 24-hour continuous run surveillance and the hot restart surveillance (SR 3.8.1.14 and SR 3.8.1.15). The TS in effect during the previous tests allowed the EDG loading to be higher than the current surveillance requirements. The licensee stated that the previous tests were more conservative than the current surveillance requirements and that the reviews of the TS amendment had failed to consider the conflict as a problem.

The problem was detected by the licensee during a review prompteo by similar conflict identified during the past week regarding other EDG surveillance requirements, which were being reviewed as part of testing of the Unit 2 EDGs. At the time of the notification, Unit 2 was in a refueling outage in Mode 6 and Unit 3 was operating at approximately 100 percent power.

A conference call was held on January 12, 1997, between licensee and NRC personnel, during which a Notice of Enforcement Discretion (t:0E0) was requested by the licensee and granted by NRR, with the understanding that an exigent TS change would be promptly submitted. The N0ED extended the 24-hour period of SR 3.0.3 to allow time for processing the TS amendment.

The TS amendment was to defer implementation of the SR requirements involved until the next Unit 3 outage (scheduled for April 1997).

The licensee also committed to perform a comprehensive review of the changes made to the TS surveillance requirements in Amendment 127, which was a major change to implement the standard TS for San Onofre.

Regional Action:

The resident staff will follow up on licensee actions.
