REQUEST TO DETERMINE REGULATORY AUTHORITY OVER CHEVRON SITE IN CLEVELAND, OHIO Enclosed is a request from Region III to determine if the Nuclear Regulatory Commission has any regulatory authority over the Chevron Corporation Plant C site on Harvard Avenue in Cleveland, Ohio. The facility was previously operated by the Harshaw Chemical Company, which made uranium chemicals for the go'vernment in the 1940's and 1950's.
Harshaw also had an Atomic Energy Commission license for possession of up to 50 lbs, of uranium and thorium.
The site has contamination that exceeds NRC and Department of Energy (DOE) limits for unrestricted release. However, DOE indicates that they have no legal responsibility or authority'to perform the remediation.
DOE has notified the Environmental Protection Agency and the Ohio Department of Health for appropriate action.
