REGULATORY AUTHORITY OVER THE CHEVRON CORP 0 RATION'S PLANT C, HARVARD AVENUE, CLEVELAND, OHIO.

We are requesting your assistance in determining if the NRC has any regulatory l

authority over Chevron's Plant C on Harvard Avenue, Cleveland, Ohio.

j Mr. Ken Lambert of my staff has had several phone conversations over the past

(

few weeks with representatives of Chevron Corporation discussing th13 issue.

Chevron has indicated it would like to begin remediation of this facility _this j'

3 year.

. The Chevron facility was previously owned.and operated by the Harshaw-Chemical Company, who had several DOE contracts in the 1940's and 1950's to process uranium ore (yellowcake) to UF4 (green salts), although the plant had the j

capability of producing UF. These contracts were. terminated in the 1950's 6

j and the. facility was decontaminated by Harshaw and released from further AEC i

j control in 1959. An Argonne National Laboratory report, dated April 1984, j

("

indicates.there are areas of the facility significantly above the current i

i unrestricted release criteria.

In letters to the Ohio Department of Health i

j and Harshaw/FILTROL Partnership (Attachment A), DOE contends that the language in the contracts relieves them from any additional responsibility, and that

.the EPA and the State of Ohio would be responsible to oversee any additional action regarding the. facility.

j Harshaw also had an AEC License No. SMC-606, Docket No. 040-1066, which 4

authorized.the possession of up to 50 pounds of thorium and uranium in chemical reagents at the Harvard Avenue location and several others. ORAU has' reviewed this terminated license and has concluded, based only on the AEC licensed activities, that no further actions regarding License No. SMC-606 are warranted.

Please evaluate these documents and advise whether you believe the NRC should have a role in the oversight of this remediation project.
